국문 초록

본 연구는 토지분쟁 해소를 위하여 우리나라의 토지등록제도와 경계관리 현황과 문제점 및 외국의 경계관리 현황을 조사·분석하여 우리나라 실정에 적합한 일필지 중심의 경계 등록 방안을 제시하는 것을 목적으로 한다. 이를 위하여 독일과 미국의 토지 등록제도와 경계관리 현황을 조사·분석하였고, 시사점으로 외국의 경우 국가마다 상이한 토지 등록제도와 경계관리 제도를 갖고 있다는 것을 확인할 수 있었다. 또한, 토지분쟁 해소를 위하여 소유 경계관리를 위한 도면과 활용을 위한 도면을 별도로 관리하고 있는 것을 확인 할 수 있었다. 따라서 우리나라도 토지분쟁을 해소하기 위하여 소유 경계관리를 위한 일필지 지적도의 도입의 필요성과 일필지 토지 경계 관리를 위한 일필지 지적도의 모형을 제시하였다. 이를 통해 토지 경계에 대한 개념의 변화를 통해 효율적인 토지관리와 소유권 보호에 기여함을 모색하고자 하였다.

영문 초록

The purpose of this study is to investigate and analyze the current status and problems of Korea's land registration system and boundary management as well as the boundary management status of foreign countries in order to resolve land disputes, and to propose a boundary registration plan centered on parcel that is suitable for Korea's situation. To this end, the land registration system and boundary management status of Germany and the United States were investigated and analyzed, and as a implication, it was confirmed that foreign countries have different land registration systems and boundary management systems. In addition, it was confirmed that the drawings for ownership boundary management and the drawings for utilization were separately managed to resolve land disputes. Therefore, in order to resolve land disputes, Korea also presented the necessity of introducing a parcel cadastral map for ownership boundary management and a model of a parcel cadastral map for land boundary management. Through this, it was intended to seek to contribute to efficient land management and ownership protection through changes in the concept of land boundary.
