스토킹 범죄 대응체계 개선 방안 연구 - 피해자 지원체계를 중심으로

국문 초록

스토킹 처벌법이 제정·시행되어 스토킹이 형사상 범죄로 규정된지 3년이 경과했다. 그러나 스토킹 범죄 신고는 지속적으로 증가하고 있고, 범죄자 처벌의 적절성뿐 아니라 피해자 구제 방안에 대해서도 한계가 지적되고 있는 상황이다. 따라서 스토킹 범죄 피해자 구제 및 대응이 적절하게 이루어지고 있는지 확인하고, 개선 방안을 도출할 필요가 있다. 본 연구에서는 이러한 목적하에 스토킹 범죄 피해자 구제 및 대응체계의 현황 및 쟁점을 분석하기 위하여 스토킹 범죄 피해자 보호·지원기관 종사자, 그리고 스토킹 범죄 피해자를 대상으로 한 면접조사 결과를 정리하였다. 이에 더해 질적 연구방법론인 근거이론에 기초하여 조사한 내용을 도식화하였다. 이러한 연구 절차에 의해 도출된 결과는 다음과 같다. 첫째, 스토킹 범죄 가해자들은 피해자를 소유하거나 통제하려는 경향이 있으며, 충동 조절이 어렵고, 자신의 행동을 정당화하고 피해자에게 책임을 전가하는 경향이 있었다. 둘째, 스토킹 범죄 피해자들은 지속적인 불안에 시달리며, 이사는 물론 직장 복귀가 어려운 등 고통이 장기화되는 경향이 발견되었다. 셋째, 범죄 발생 및 대응 특성과 관련하여 최근 스토킹이 범죄라는 인식이 퍼지면서 신고가 증가했으나, 부부나 연인 간 스토킹은 여전히 계속되고 있었다. 경찰과의 협업 및 법적 조치에도 불구하고, 피해자들은 여전히 불안을 강하게 느끼고 있었다. 넷째, 피해자에 대한 공적 지원에도 불구하고 피해자들은 여전히 경제적, 법적 지원의 부족을 느끼고 있으며, 공식 절차의 한계도 지적되고 있었으며, 특히 접근금지 조치 등의 실효성이 부족에 관한 의견이 많았다. 마지막으로, 제도 개선 방향과 관련해서는 경찰의 태도 개선, 가해자의 위치 정보 제공, 경제적 지원 확대, 형사절차 지원 접근성 향상, 가해자 대상 프로그램의 필요성이 제기되었으며, 피해자 보호뿐만 아니라 가해자에 대한 상담 및 치료 프로그램도 필요하다는 의견이 강조되었다. 이 연구는 일부 스토킹 피해자 보호·지원 기관 종사자와 소수의 피해자를 대상으로 연구를 수행하였기 때문에 일반화에는 한계가 존재한다. 다만, 스토킹 지원 현황을 가장 가까이서 경험하고 인식하는 기관 종사자와 피해자를 대상으로 의견을 수렴한 만큼 현실적이고 실효성 있는 스토킹 범죄 피해자 지원을 위한 구체적 개선 방안을 제시한 것으로 판단된다.

영문 초록

It has been three years since the Stalking Punishment Act was enacted and enforced, classifying stalking as a criminal offense. However, reports of stalking crimes continue to rise, and there are noted limitations not only in the adequacy of punishing offenders but also in the measures for victim relief. Therefore, it is necessary to verify whether the relief and response to stalking crime victims are being appropriately handled and to derive improvement measures. This study aims to analyze the current status and issues of the relief and response system for victims of stalking crimes. To this end, interviews were conducted with employees of institutions that protect and support victims of stalking crimes, as well as the victims themselves. Additionally, the findings were schematized based on the qualitative research methodology known as Grounded Theory. The results derived from this research process are as follows: First, perpetrators of stalking crimes tend to exhibit behaviors aimed at possessing or controlling the victim, have difficulty controlling impulses, justify their actions, and shift the blame to the victim. Second, victims of stalking crimes suffer from ongoing anxiety, with challenges such as relocation and returning to work, leading to prolonged suffering. Third, concerning the characteristics of crime occurrence and response, awareness of stalking as a crime has recently spread, leading to increased reporting, but stalking between spouses or partners persists. Despite collaboration with the police and legal measures, victims continue to feel significant anxiety. Fourth, despite public support for victims, there is still a perceived lack of economic and legal support, with many pointing out the limitations of official procedures, particularly the ineffectiveness of restraining orders. Finally, regarding the direction for system improvement, suggestions include improving police attitudes, providing location information of perpetrators, expanding economic support, enhancing accessibility to criminal procedure support, and the necessity for programs targeting perpetrators. There is an emphasized need for counseling and treatment programs for perpetrators, in addition to victim protection. This study has limitations in generalization as it was conducted with only a few employees of victim protection and support institutions and a small number of victims. However, as it gathered opinions from those who experience and perceive the current state of stalking support most closely, it is believed to have proposed practical and effective improvement measures for the response system supporting victims of stalking crimes.
