농민의 기본권 시각에서 본 농지취득·소유제도의 문제점에 관한 고찰

국문 초록

2021년 3월경 한국토지주택공사(LH) 직원들의 신도시 사업지역의 토지 투기성 매입 문제가 발생함으로써 ｢농지법｣이 여러 차례 개정되었고, 그 내용으로는 농지의 취득 및 소유를 엄격하게 제한하는 것이었다. 현재, 농촌은 인구의 감소, 고령화 심화, 청년세대 유출, 다문화 가구의 급증 등으로 인하여 인구구조가빠르게 변화하고 있으며, 이에 농촌은 소멸 위기 현상을 겪고 있다. 그런데 은퇴를 하고자 하는 농민, 채무변제에 시달리는 농민, 생활자금을 마련하고자 하는 농민 등은 농지를 매도해야 하는데, 매수할 대상자를찾을 길이 없어 농지 거래가 사실상 중단된 상태이다. 이 논문에서는 이러한 문제의식을 바탕으로 ｢헌법｣상 규정된 ‘경자유전의 원칙’의 폐기 가능성을 검토하면서, 농민의 기본권 보장 측면에서 문제의식을 가지고 현재 농지취득 및 소유에 관한 ｢농지법｣의 문제점은 무엇이고 이것을 어떻게 해결할 것인지 그 해결책을 제시하고자 한다.

영문 초록

March 2021, the ｢Farmland Act｣ was revised due to the issue of land speculative purchases in new city business areas by employees of the Korea Land and Housing Corporation(LH). So the content of Farmland was to strictly restrict the acquisition and ownership of farmland. Currently, the demographic structure of rural areas is rapidly changing due to a decrease in the population, a deepening aging population, an outflow of young generations, and a rapid increase in multicultural households. However, farmers who want to retire, farmers who suffer from debt repayment, and farmers who want to raise living funds have to sell their farmland, but the farmland transaction has been virtually suspended because there is no way to find someone to buy it. Based on this awareness of the problem, this paper examines the possibility of scrapping the ‘The principle of farmland ownership’ stipulated in the ｢Constitution｣, and with a awareness of the problem in terms of guaranteeing farmers’ basic rights, we would like to present the problems of the current ｢Farmland Act｣ on the acquisition and ownership of farmland and how to solve it.
