한미상호방위조약의 국제법적·외교적 함의와 파급효과

국문 초록

1953년 체결된 한미상호방위조약은 한마디로 말해서 조약의 형식을 빌어 한미군사동맹을 제도화한 것이었다. 이 방위조약은 냉전시대 초기에 대한민국을 서구자유진영에 편입시키는 국제정치적 효과를 발생시켰으며, 북･중 동맹관계를 견제하는 외교･군사적 대응 메커니즘으로 작동하였다. 한미상호방위조약은 무엇보다도 한미동맹관계를 공고히 하는 데 이바지하였으며, 그로 인한 국제법적･외교적 파급영향도 매우 컸다. 1957년 한미우호통상항해조약 체결의 견인차 역할을 했고, 유엔전문기구 등에서 국제협력의 토대를 구축･확대하는 데 많은 기여를 했다. 또한 한국이 샌프란시스코 평화조약 체제에 간접적으로 가담하는 한편, 1965년의 한일 국교정상화를 촉진하는 역할을 하기도 했다. 한국이 한미상호방위조약을 통해 미국을 지구상의 여러 나라들 가운데서 유일한 동맹국으로 수용한 이상 동맹국에 걸맞게 미국을 대접하고 예우해야 한다. 21세기 우리는 한미상호방위조약을 바탕으로 한미관계를 ‘21세기 글로벌 전략동맹’으로 발전시켜 나가야 한다. 또한 통일과정에서 북한의 변화를 촉진하는 기제로 활용해야 할 책임이 있다.

영문 초록

The South Korea-U.S. Mutual Defense Treaty, signed in 1953, was, in a nutshell, an institutionalization of South Korea-U.S. military alliance as a form of a treaty. In the early Cold War era, this defense treaty had an international political effect of incorporating the Republic of Korea into the camp of Western free world and acted as a diplomatic and military response mechanism to check the alliance between North Korea and China. Above all, the Korea-U.S. Mutual Defense Treaty contributed to the solidification of the Korea-U.S. alliance, and the impact of international legal and diplomatic relations was significant. It served as a driving force for the signing of Friendship, Commerce and Navigation(FCN) Treaty between South Korea and the U.S. in 1957, and contributed a lot to establishing and expanding the foundation for international cooperation in UN specialized organizations and other global stage. It also played a role in promoting the normalization of diplomatic relations between Korea and Japan in 1965 while indirectly participating in the San Francisco Peace Treaty system. As long as South Korea has accepted the U.S. as the only one ally among many countries on the planet through the Korea-U.S. Mutual Defense Treaty, it should treat and honor the U.S. as befitting its ally. In the 21st century, we should develop Korea-U.S. relations into a “21st century global strategic alliance” based on the Korea-U.S. mutual defense treaty. It is also responsible for using it as a mechanism to promote change in North Korea during the unification process.
