출소자 공단 생활관 입소경험에 관한 연구

국문 초록

출소자의 성공적인 자립을 위해서 다양한 방안들이 모색되고 있지만, 가장 우선적으로 갖춰야할 조건은 안정적인 생활환경의 마련이다. 상당한 시간 동안 사회로부터 격리되어 있다가 모든 것이 부족한 상태로 나오는 출소자들은 이후 생계가 매우 막막해 충동적으로 부정적인 사건·사고에 휘말릴 수 있다. 특히, 최근 있따라 출소한 고위험 성폭력범죄자의 처우와 관련하여 국민적 불안이 커지고 있고, 관련 사안에 대해 정부는 ‘한국형 제시카법’을 화두로 제시하여 논의 단계에 있다. 이에 범죄예방 및 사회공동체 안정 역할로써 출소자들의 단계적 자립을 준비하도록 지원하는 정책 중에서 한국법무보호복지공단의 숙식제공사업의 중요성이 크다. 2019년부터 숙식제공은 전환기를 맞이하였다. 기존 공단 직원 중심의 생활관 이용자 관리·감독에서 자치운영제도 및 자율형 생활관 도입을 통한 공동생활방식을 채택·시행하고 있다. 자율형 생활관은 직원의 개입은 최소한으로 하고, 생활관 이용자들 간 공동생활에 필요한 규율을 지키도록 유도하는 운영 방식이다. 이에 본 연구에서는 전환기에 따른 숙식제공 경험에 관한 질적 사례연구를 실시하였다. 공단에서 생활하는 숙식제공 이용자의 경험음 심층적으로 분석하기 위해 3개의 지부에서 총 15명을 선정하여 FGI 및 개별 심층 인터뷰를 실시하고, 사례연구를 진행하였다. 문서화한 녹취록을 바탕으로 개방코딩을 수행하고, 자료축소 방법을 적용하였다. 연구결과, 숙식제공 현황 및 성과와 숙식제공 자립의 과제 범주로 구분할 수 있고, 이에 대한 주요 개념으로 ‘최소 자립 생활 환경 마련’, ‘사회적 애착관계 형성’으로 분류할 수 있었다. 총 8개의 하위범주에 대해 24개의 개념을 도출하였고, 맥락상 개념의 차원과 속성을 정리하였다. 이러한 연구결과를 바탕으로 출소자의 숙식제공이 가지는 자립의 의미와 ‘한국형 제시카법’과 관련한 공단의 역할에 대해 논의하였다.

영문 초록

An array of measures is being considered to support the successful reintegration of ex-convicts into society, but the most important condition is the establishment of a stable living environment. When individuals who have been isolated from society for a considerable period of time are released without anything to their name, they may be tempted to engage in impulsive and anti-social behaviors. As part of crime detterence and community rehabilitation efforts, the Korea Rehabilitation Agency provides ex-convicts with accommodation and meals as part of an effort to prepare and support them towards gradual self-independence. In particular, there has been growing public anxiety regarding the treatment of high-risk sexual assault offenders who have recently relaesed from prison. According to this issue, the government has proposed a “Korean Jessica’s Law” as a topic of discussion There has been a transition period in the provision of accommodation and food services since 2019. Instead of relying on staff-centered management and supervision of residents, the Korea Rehabilitaion Agency has adopted and implemented a self-governing system for communal living.Residents of the self-governing dormitories are encouraged to follow the necessary rules for communal living with the minimal involvement of the staff. This study examined the experiences of individuals who accessed the accommodation and meal services during the transitional period through a qualitative case study. Using a focus group interview methodology and individual in-depth interviews, 15 participants from three branches of the Korea Rehabilitation Agency were selected for in-depth interviews, and case studies were conducted. Data reduction and open coding techniques were used to analyze the transcribed recordings. During the study, two categories of results were identified: the current state and results of the program, and the challenges that ex-convicts face in achieving independence. A minimum independent living environment and the formation of positive social attachment relationships were identified as the key concepts for these categories. We derived 24 concepts from eight subcategories, and the dimensions and attributes of each concept were organized according to the context of each concept. We discussed the meaning of independence achieved through the shelter program for ex-convicts and the role of the Korea Rehabilitation Agency in relation to the Korean Jessica’s Law.
