한국형 제시카법의 주요 쟁점과 헌법 적합성

국문 초록

아동성범죄자 등을 포함한 고위험 성범죄자에 대해서 출소 후 출소자의 거주를 제한하는 일명 ‘한국형 제시카법’의 도입이 정부에 의해서 추진되고 있다. 한국형 제시카법의 주요 내용은 어린이집과 유치원을 포함한 초･중･고･대학 인근과 학생 밀집지역 등으로부터 500m 이내에 살지 못하도록 하는 것으로 미국의 제시카법과 유사한 내용을 예정하고 있다. 한국형 제시카법은 ① 거주제한 대상 및 범위의 광범위한 설정으로 자유권적 기본권을 과도하게 침해할 우려가 매우 크다는 점, ② 성범죄자에 대한 여러 보안처분제도가 도입되어 있음에도 불구하고 침익성이 큰 새로운 보안처분을 도입하는 것이라는 점, 그리고 ③ 다양한 보안처분을 중첩적으로 적용한다는 점에서 헌법상 죄형법정주의 및 비례성원칙을 침해할 가능성이 매우 크다. 따라서 한국형 제시카법의 도입에 있어서는 우선 이미 도입되어 있는 전자감시와 신상정보공개･등록제도 및 취업제한제도 등의 실효성을 확보하여 적극적으로 활용하는 방안을 고려할 필요가 있고, 그러한 전제하에서 거주제한은 접근금지명령의 요건수준으로 대상자와 적용범위를 한정하는 것이 바람직할 것으로 보인다.

영문 초록

For high-risk sex offenders, including child sex offenders, the government is promoting the introduction of the so-called “Korean Jessica Act,” which restricts the residence of those released from prison. The main content of the Korean version of the Jessica Act is to prohibit living within 500m of elementary, middle, high school, and university neighborhoods, including daycare centers and kindergartens, and areas with high concentration of students. The Korean version of the Jessica Law raises significant concerns about excessive infringement upon fundamental human rights through a broad and extensive scope of residency restrictions. Despite the existence of various security measures already implemented for sex offenders, introducing a new security measure with the potential for significant infringement upon basic rights is worrisome. Moreover, the application of multiple security measures in a cumulative manner poses a high risk of violating the principles of ‘no penalty without a law’ and proportionality as guaranteed by the constitution. Therefore, in introducing the Korean version of the Jessica Act, it is necessary to first consider ways to secure the effectiveness of the already introduced electronic surveillance, personal information disclosure/registration system, and employment restriction system and actively utilize them. And under such a premise, it would be desirable to limit the subject and scope of application to the level of requirements of the access prohibition order.
