국문 초록

이 연구는 교육과정편성권을 교육제도 법정주의 중심으로 교육제도, 교육법, 교육과정편성권의 헌법적 적합성에 대하여 고찰하고, 교권보호 법정주의 관련 일선 학교교육 현장에서 발생되는 문제점을 파악하여, 개선방안에 대한 이해를 돕고 시사점을 제공하고자 하였다. 연구결과는 다음과 같다. 교육제도 법정주의는 국가가 국민의 교육을 받을 권리를 헌법 제31조 제6항에 법정화 함으로써 국민의 교육 받을 권리를 보장하는 것이 법정주의 개념임을 확인 할 수 있었고, 교육과정과 교육법은 상호간 일치하지 않거나, 둘 중 어느 한쪽에서 미흡한 내용이 나타나기도 한다. 따라서 교육과정편성권의 교육학적 대안과 미래 세대에 적합한 방향성은 시대상황에 적합한 전문가집단의 논의와 국민적 합의를 통해 반복적이고 점진적인 개정이 필요하며, 이를 관리 감독할 정부부처, 교육청 내 관련 부서신설과 인력충원도 검토해야 할 것이다.

영문 초록

In this study, we examine the constitutional suitability of the education system, education law, and the right to organize curriculum, focusing on the statutory right to organize curriculum, and identify problems that arise in the field of school education under the law regarding the right to organize curriculum. Right to education. , suggest improvement measures. The goal was to aid understanding and provide implications. Here are the research findings. The legalism of the education system confirms that the concept of statutoryism entails the state guaranteeing the people's right to education by enshrining the people's right to receive education in Article 31, Paragraph 6 of the Constitution. It was also observed that the curriculum and education laws may not align with each other, and there could be insufficient content in one of the two. Therefore, pedagogical alternatives for curriculum planning rights and directions suitable for future generations require repeated and gradual revision through expert group discussions and national consensus appropriate to the times, and the establishment of relevant departments and manpower within government ministries and offices of education to manage and supervise them. Recruitment will also need to be reviewed.
