생활지도는 어떻게 규율되어야 하나?

국문 초록

이 글은 교사의 교권 강화 방안의 일환으로 2023년 9월에 제정된「교원의 학생생활지도에 관한 고시」와 ‘교원의 학생생활지도에 관한 고시 해설서’를 공법이론과 현장교육의 관점에서 그 문제점을 분석하고 개선 방안을 제시하는 것을 목적으로 한다. 이러한 목적을 달성하기 위하여 우선「교원의 학생생활지도에 관한 고시」와 ‘교원의 학생생활지도에 관한 고시 해설서’를 검토하였다(Ⅱ). 이를 바탕으로 ‘고시’의 형식과 그 세부 내용의 문제점을 찾고 이에 대한 개선 방안을 제시하였다(Ⅲ). 마지막으로 이상의 논의를 정리하였다(Ⅳ). 생활지도권은 “학교의 장과 교원이 학업, 진로, 보건, 안전, 인성, 대인관계, 그 밖에 학생생활과 관련한 사항에 대해 조언, 상담, 주의, 훈육, 훈계, 보상 등을 하는 행위”로 정의할 수 있다. 이것은 학생의 교육기본권을 보장하고 실현하기 위한 교육행위이다. 그런데 일부 생활지도는 필연적으로 학생의 기본권을 제한하는 효과를 가져온다. 따라서 이와 같은 유형의 생활지도를 대외적 효력이 없는 행정 규칙인 고시로 규정하는 것은 헌법 제37조 제2항이 명시하는 법률유보 원칙에 반하는 위헌성을 내포한다. 한편 국가는 헌법 제31조에 따라 교사 생활지도의 자주성과 전문성을 보장해야 하며, 학생의 교육기본권을 강화하는 방향으로 행사하는 교사의 생활지도권은 국가에 대해 기본권으로 주장할 수 있다. 이에 비추어 고시의 일부 규정은 교사의 생활지도 방식을 지나치게 상세하게 규정하여 교사의 생활지도권을 침해하는 또 다른 위헌성을 내포하고 있다. 이런 이유로 고시 중 학생의 인권에 관한 사항은 「초ㆍ중등교육법」에서 정하고 세부 내용은 같은 법 시행령에 위임하여 규정해야 한다. 또한 고시 중 교사의 생활지도에 관한 구체적인 행사에 관한 사항은 ‘(가칭)학생 생활지도에 관한 가이드라인’과 같은 연성법으로 정하는 것이 타당하다.

영문 초록

This article provides a legal analysis of 「The Ministry of Education’s Notice on Teachers’ Guidance of Student Life」and ‘The Commentary on the Notice on the Ministry of Education’s Notice on Teachers’ Guidance of Student Life, which were enacted in September 2023 as part of a plan to strengthen teachers' teaching power and rights, and examines their effectiveness. The purpose is to suggest ways to strengthen it. To achieve this purpose, we first reviewed the contents of the Notice on Teachers' Guidance of Student Life and the Explanation of the Notice on Teachers' Guidance of Student Life(Ⅱ). Based on this, problems and improvement plans were proposed, focusing on the format and details of the “Notice”(Ⅲ). Finally, the above discussion was summarized and the direction of the Student Life Guidance Regulations was proposed(Ⅳ). As a result of the discussion, student life guidance is a residual category of educational activities excluding subject education, and corresponds to an educational method for guaranteeing and realizing students' basic educational rights. Therefore, the Notice on Teachers' guidance of student Life should be abolished, and matters restricting students' fundamental rights should be regulated by laws or regulations. In other words, among the contents of student life guidance, basic matters concerning students' human rights should be regulated by the Elementary and Secondary Education Law, and detailed matters should be delegated and regulated by the implementing regulation of the same law. In addition, it is appropriate to regulate matters concerning specific events related to teacher guidance in the form of soft law, “Guidelines for Student Life Guidance”.
