국문 초록

이 연구의 목적은 학교폭력 피해학생으로부터의 가해학생 분리 법령 및 정책과 가해학생 조치에 대한 법적 쟁송 현황 등을 분석하고, 가해학생 분리 및 이행 지연의 쟁점 및 입법적·정책적 개선방안을 도출하는 데에 있다. 2020년부터 2022년까지 학교폭력 가해학생이 청구한 행정심판 및 행정소송의 본안 청구 건수는 모두 크게 증가하였으나, 인용률은 모두 낮아지고 있고 2022년에는 10% 내외 수준인 것으로 나타났다. 그러나 행정심판 및 행정소송의 집행정지 인용율은 약 50~60%로 높으며, 이는 피해학생의 피해를 제대로 고려하지 않은 채 가해학생의 학습권 보장에 기여하고 있는 것으로 나타났다. 이로 인한 쟁점 및 문제점으로는 법적 쟁송 등으로 피해학생 보호 미흡 및 가해학생 분리 집행 지연, 가해학생 조치의 학생부 기재 및 삭제의 실효성 약화, 출석정지ㆍ학급교체 및 교내·사회봉사 등의 분리·반성 효과 미흡 등이 지적된다. 이에 실태조사 결과와 법제 분석을 통해 도출된 문제점을 해소하고 가해학생 분리 등을 위한 개선방안을 다음과 같이 제시하였다. 첫째, 행정심판ㆍ행정소송 운영 개선 등 가해학생 불복 쟁송 기간 단축이다. 둘째, 학생부 기재 기간 확대 및 소송 종결 후 상급학교 입시 재반영 제도 도입이다. 셋째, 학급교체ㆍ출석정지 등 분리 조치 강화 및 실효성 제고가 필요하다.

영문 초록

This study aims to analyze laws and policies concerning the separation of offending students from victims of school violence. It identifies issues related to the separation process and delayed implementation. Additionally, the study explores potential legislative and policy improvements. Between 2020 and 2022, there was a significant increase in the number of administrative judgments and lawsuits filed by students accused of school violence. Surprisingly, during this period, the citation rate witnessed a steady decline, reaching approximately 10% by 2022. In contrast, the citation rate for execution suspension in administrative judgments and lawsuits remained high, hovering around 50-60%. This trend highlights a concern that, while prioritizing the perpetrator's right to education, the damage to the victim may not be adequately considered. The identified issues stemming from this analysis include insufficient protection for victim students due to legal disputes, delays in separating and executing disciplinary actions for offending students, and shortcomings in managing student records and the efficacy of separation measures such as attendance suspension, class replacement, and school/social services. To address these challenges, the following improvement measures are proposed: (1) Shorten the appeals period for offending students by enhancing the efficiency of administrative judgments and litigation. (2) Extend the student record period and implement a system to consider disciplinary outcomes in higher school entrance exams even after legal proceedings conclude. (3) Strengthen segregation measures, such as class replacement and attendance suspension, and enhance their effectiveness.
