부동산 조각투자의 개념정립에 관한 연구

국문 초록

본 연구는 부동산 조각투자에 대한 기본적인 개념과 특성을 조사·분석하여 부동산 조각투자의 학술적 개념을 정립하는 것이 목적이었다. 연구 결과, 부동산 조각투자의 개념정립을 위해 부동산 조각투자의 정의와 특성 등을 제시하였고, 국내·외의 부동산 조각투자 실태 분석을 통해 개념정립의 필요성을 살펴보았다. 또한, 선행연구에서의 부동산 조각투자 개념을 살펴보았고, 개념정립의 방향을 제시하였다. 부동산 조각투자 플랫폼의 상용화가 얼마 되지 않았고, 그 용어와 구조가 생소하며, 친숙하지 않아 명확한 개념이 정립되지 않은 현시점에서 조속히 용어의 학술적 개념정립과 관련 제도의 도입이 요구되었다. 특히, 부동산 조각투자의 추구 목적, 범위와 원리 등을 면밀히 검토해야 하며, 부동산 조각투자는 일반적인 조각투자와는 달리 「민법」상의 소유권에 초점을 두는 것이 아니라, 「자본시장법」상의 증권으로 바라보아야 하며, 따라서 관계 법령을 검토하고, 부동산 조각투자의 범위 즉, 조각투자와의 차이를 두고, 그 방향에 대하여 접근해야 함을 제시하였다.

영문 초록

This research aimed to define the academic concept of real estate fractional investment by exploring and analyzing its fundamental concepts and unique characteristics. The findings of this study highlighted the need to define the concept of real estate fractional investment by outlining its definition and characteristics, and by analyzing its status both domestically and internationally. The study also revisited the concept as understood in prior research, suggesting directions for its future development. Given that real estate fractional investment platforms have only recently been commercialized and their terminology and structure remain largely unfamiliar, there is an immediate need for a clear academic definition of these concepts and the introduction of relevant regulatory frameworks. In particular, the study emphasizes the importance of thoroughly examining the goals, scope, and underlying principles of real estate fractional investment. Distinct from typical fractional investments which center on ownership rights as per 「Civil Law」, real estate fractional investments should be viewed through the lens of securities under 「Capital Market Law」. This necessitates a careful review of relevant legal frameworks and a strategic approach in distinguishing real estate fractional investments from other forms of fractional investments, as well as in determining their specific direction and scope.
