인신매매방지법상 피해자 확인서 발급제도의 개선방안

국문 초록

인신매매방지법 제14조(피해자 확인서 발급)에 의하면, 인신매매등 피해를 입은 자 또는 법 제21조 제2항에 따른 신고의무자는 여성가족부장관에게 확인서 발급을 요청할 수 있고, 이에 따른 피해자 확인서 발급시 피해자에 해당하는지를 심의·판정하기 위하여 법 제15조에 따른 지역인신매매등피해자권익보호기관에 인신매매등사례판정위원회(이하 “판정위원회”라고 한다)를 둔다. 이 경우 판정위원회의 운영및 구성에 관하여 필요한 사항은 대통령령으로 정한다. 그리고 여성가족부장관은 판정위원회의 판정을 거쳐 대통령령으로 정하는 바에 따라 확인서를 발급할 수 있다. 여성가족부장관은 확인서 발급에 관한 사항을 법 제15조에 따른 중앙인신매매등피해자권익보호기관에 위임할 수 있으며, 피해자 확인서를 외국인에게 발급한 경우에는 법무부장관에게 관련 자료를 송부하여 「출입국관리법」 제25조의2 및 제46조의2의 적용을 요청할 수 있다. 이와 같은 피해자 확인서 발급제도는 인신매매방지정책의 조기정착에 있어서 성패를 좌우할 수 있을 만큼 그 운용이 대단히 중요하다고 평가할 수 있는데, 대강만이 법률에 규정되어 있을 뿐 실제 발급의 요건이나 절차 등에 대해서는 하위법령에 대체적으로 위임되어 있는 실정이다. 하지만 보다 중요하고도 시급히 해결해야 할 문제점은 피해자 확인서를 발급하는 실질적인 주체라고도 할 수 있는 지역인신매매등피해자권익보호기관이 법 시행 후 약 1년여가 다가옴에도 불구하고 전국 17개 시·도 가운데 그 어디에도 설치된 실적이 전무하다는 것이다. 이에 따라 실제 인신매매피해 사례가 인지되거나 발굴된 경우에 이를 인신매매방지법에 의하여 지원해 줄 수 있는 연결고리 자체가 존재하지 않는 심각한 문제가 발생하고 있다. 이와 같은 문제의식을 바탕으로 아래에서는 인신매매방지법의 도입배경 및 입법목적을 살펴보고 현행 법령에 규정되어 있는 피해자 확인서 발급제도의 주요 내용을 분석한 다음 동제도의 실질적인 활용을 위한 합리적인 개선방안을 도출해 보도록 한다.

영문 초록

According to the Article 14 (Issuance of Certificate of Victim) of the Act on Prevention of Human Trafficking, the victim of human trafficking or the person bound in duty to give the notification in accordance with Clause 2, Article 21 of the Act may ask the Mister of Gender Equality and Family for issuance of a certificate, and if the certificate is issued, a case judgment committee such as a local institute for protection of rights and interests of victims (hereinafter“Judgment Committee”) shall be installed in accordance with Article 15 of the Act to deliberate and judge if the person is a case of victim. In this case, matters necessary for operation and composition of Judgment Committee are decided by the Presidential decree. And the Mister of Gender Equality and Family may issue a certificate by the Presidential decree after judgment by Judgment Committee. The Mister of Gender Equality and Family may entrust central institute for protection of rights and interests of victims with matters related to issuance of certificate in accordance with Article 15 of the Act, and ask application of Article 25-2 and Article 46-2 of the「Immigration Control Act」by sending relevant materials to the Minister of Justice if a certificate is issued for a foreign nationals. Operation of the system for issuance of certificate of victim is considered very important as the system can determine success and failure of early settlement for the policy to prevent human trafficking, but only the outline is regulated by the law, and requirement or procedure for actual issuance are generally entrusted to the lower laws. However, the more important and urgent problem to be solved is that even though the Local Trafficking Victim Rights Protection Agency, which can be said to be the subject of issuing the victim's certificate, has been around for about a year since the enforcement of the law, none of the 17 cities and provinces in the country have been established. As a result, there is a serious problem that there is no link that can support the actual cases of human trafficking if they are recognized or discovered by the Anti-Trafficking Act., Based on this critical mind, the background of the introduction of the Ant-Trafficking Act and the purpose of the legislation are examined below, and the main contents of the victim identification issuance system prescribed in the current laws and regulations are analyzed, and then a reasonable improvement plan for practical use of the system is derived.
