국문 초록

학술저작물은 일단 합법적으로 습득하면 그 이후의 이용에는 크게 신경쓰지 않는경우가 많다. 사적이용이나 공정이용에 해당한다고 생각하기 쉽고, 또 학술저작물이라는 특성상 출처만 정확히 표기한다면 저작권법의 테두리 안에서 완벽하게 합법적인 이용이라고 오해할 수 있다. 물론 모든 저작물의 합법이용과 불법이용을 물과 기름에 빗대어 둘을 가르는 기준을 세우기는 어렵겠지만, 학술저작물의 경우에는 이용환경과 이용 형태가 상대적으로 다양하게 나타나고, 저작권법에서도 학술저작물의 성격을 고려하여 침해 여부를 판단하는 규정들이 일부 있어서 합법이용과 불법이용의구분이 더욱 어렵다. 이용자 입장에서는 저작권 제한사유를 주장할 수 있지만 권리자입장에서는 저작권 침해를 주장할 수 있는 회색지대가 존재할 수 있다는 의미이다. 이 글에서는 학술저작물의 이용 실태와 저작권 라이선스 쟁점을 다루었다. 주제의선정 배경은 기업이 의존하는 정보의 가치는 높아지는 반면 그 정보를 담은 학술저작물의 합법적인 이용에는 소홀할 수 있는 현실에 착안하였다. 다양한 분야의 학술저작물 중에서도 산업 발전과 밀접히 연관된 ‘과학, 기술, 의약학 분야의 학술저작물(STM 학술저작물; science, technology, medical academic works)’에 집중하였다. STM 학술저작물의 특성에 기반해서 그 이용 형태를 살펴보고, STM 학술저작물이 이용되는 과정에서 잠재적인 저작권 침해 요소가 존재하는지 사례를 통해 살펴보았다. 더욱이 디지털 환경에서는 그 이용 형태가 다양하게 나타나고 있어서 이용자 입장에서는 STM 학술저작물을 합리적인 가격으로 침해에 대한 부담없이 이용할 수 있는시스템이 필요하고, 권리자 입장에서도 개별적으로 이용허락하는 번거로움을 줄이면서, 계약 후 허락된 범위 내에서 이용되고 있는지의 여부 확인이나 침해 발생에 대한대응 등에 소요되는 시간과 비용을 줄일 수 있는 방안이 필요하다. 미국 등 일부 국가에서는 STM 학술저작물 이용을 위한 라이선스 모델을 운영하고있는데, 이러한 모델이 국내에도 적용될 수 있는지를 검토하여 국내 학술저작물 시장의 안정적인 발전을 위한 방향을 제시하고자 하였다.

영문 초록

Once an academic work is legally acquired, we are little concern about its subsequent use. It is easy to think that types of use could be private use or fair use, which is exceptions and limitations of copyright. Furthermore, it can be misunderstood that it is not copyright infringement as long as we clearly indicate the source in the paper. It is difficult to set a standard of leg al and illeg al use of all works in comparisions to oil and water. However, in the case of academic works, it is more difficult to distinguish between legal and illegal use because types of its use are relatively diverse in the digital environment and some limitation regulations contain the characteristics of academic works in the copyright act. There may exist gray area which users can claim copyright exceptions and limitations while right holders can claim copyright infringement. This article deals with the reality of use of academic works and copyright licensing issues. This paper chooses academic works as a subject because while companies gradually depend on the valuable information, the legal use of academic works containing that valuable information can be neglected. Among various academic works, this paper focuses on ‘academic works in science, technology, and medicine (STM academic works)’ which are closely related to industrial development. Based on the characteristics of STM academic works, this paper examines potential copyright infringement factors in the process of using STM academic works. Considering diverse types of use of STM academic works in the digital environment, users want access to them at a reasonable price without worry of copyright infringement, and rig ht holders want to save time and money for contracting an ag reement, checking compliance, and suing infringers. Some countries, such as the United States, Japan, and Germany, are operating license models for the use of STM academic works. Examining above license models, this paper emphasizes the necessity of licensing model for STM academic works in Korea so that academic works publishing market of Korea could be stably developed.
