국문 초록

인터넷상의 댓글은 인터넷 공간에서 게시물에 대한 수용자(독자)의 응답행동의 결과물이자 메시지 형태로 나타내는 글인 반면 악성댓글은 내용과 상관없이 게시자 또는 특정인을 비난하거나 조롱하는 내용을 의도적으로 게시하는 글이라 할 수 있다. 그러므로 악성댓글은 타인에 대한 욕설이나 비방, 사생활 침해, 폭력 또는 사행성 조장, 음담패설, 도배글 등을 포함하게 된다. 그런데 악성 댓글과 관련한 제 문제는 인터넷 사용이 보편화되면서부터 발생한 것으로 어제 오늘의 문제는 아니다. 물론 과거에는 주로 공인(정치인, 유명연예인, 스포츠스타 등)과 관련된 언론 기사에 달리는 악성댓글에 대한 문제가 주로 논의되었던 반면에 최근에는 쌍방향 미디어플랫폼의 영향력으로 일반인을 상대로 한 악성댓글 역시 사회문제로 인식되기 시작한 것에 차이가 있다. 이에 최근 우리사회에서는 미디어플랫폼을 통해 매개되는 게시물의 악성 댓글과 관련한 대응방안에 대한 논의가 뜨거운 감자로 부상하고 있다. 본고에서는, 인터넷상의 악성댓글과 관련한 대응방안에 대한 고찰의 일환으로 최근 개정을 실시한 일본의 「서비스 제공자 책임제한법」에 대한 내용과 시사점을 바탕으로, 악성댓글과 관련한 서비스 제공자의 적절한 규제유형을 도출하여, 우리가 나아가야 할 바람직한 방안에 대해 고찰해 보았다.

영문 초록

Comments on the Internet are the result of responding behavior of recipients(readers) to posts in the Internet space and are written in the form of messages, whereas malicious comments are intentionally posted content that criticizes or ridicules the publisher or a specific person regardless of the content. can Therefore, malicious comments include abusive language or slander against others, invasion of privacy, promotion of violence or speculative behavior, obscene language, and spamming posts. However, the problem related to malicious comments has occurred since the use of the Internet became common, and it is not a problem of yesterday or today. Of course, in the past, the issue of malicious comments in media articles related to public figures (politicians, famous celebrities, sports stars, etc.) was mainly discussed, but recently, malicious comments against the general public have also become a social problem due to the influence of interactive media platforms. is beginning to be recognized. Accordingly, discussions on countermeasures related to malicious comments on posts mediated through media platforms have recently emerged as a hot potato in our society. In this paper, based on the content and implications of Japan's “Service Provider Liability Limitation Act”, which was recently revised as part of a consideration of countermeasures related to malicious comments on the Internet, appropriate regulatory types for service providers related to malicious comments were derived. So, we considered the desirable way to move forward.
