교정사회복지사제도의 입법적 필요성

국문 초록

현대사회는 개인의 노력으로 살아가기가 어려운 구조적인 부조리가 나타나며 빈부의 격차와 함께 양극화에 대한 사회적 다극화현상이라고 볼 수 있다. 이러한 현실적 이해를 전제한다면 이제 개인의 삶에 대한 질을 어떻게 해야 할 것인가에 대한 문제가 당면 과제로 부각된다. 그러나 현실은 이런 사회적·문화적·경제적인 문제에 직면하여 개인이 이를 극복하는 과정에서 나타나는 구조적인 한계에 부딪히는 제 문제를 극복하거나 최소화하기위한 방안의 하나로 제도적인 삶의 질을 보장하는 것을 기본적인 권리로 요구하고있다. 사회적 변화와 흐름에 따라 사회복지가 국가의 주요 정책으로 갈수록 비중이 커가면서 이에 대한 인력과 예산의 증가는 불가피하게 되었다. 일선기관에서의 사회복지 전담 공무원 수도 지속적으로 증가하고 있고 자연스럽게나타나는 공무원의 증원에 따라 더 증가 할 것으로 예상된다. 보편적으로 인식된 사회복지사의 역할은 전문영역과 속해있는 사회복지기관이나시설의 특성에 따라 다양하게 나타난다. 우리사회에서 사회복지사에 대한 초기 인식은 봉사직으로 무급이거나 약간의 유급직원으로 인식하는 경향이었지만 지금은 확연히 달라진 사회적 위상을 느낄 수 있다.이 논문에서 중점적으로 제안하고자 하는 것은 아직 법제화되지 못했지만 향후 여러 가지 논의를 거쳐 그 필요성을 인식하고 교정행정을 원활하게 지원하는 것을 가능하게 하는 ‘교정사회복지사’에 대한 인식과 함께 동반되는 법적인 정비의 시급함을구체적으로 논의하고 여기에 따른 다양한 의견을 수렴하는 전향적인 발상의 전환을요구한다. 앞으로 사회복지사의 법적 지위와 업무의 특성을 고려한 법적자격의 강화, 전문사회복지사의 법제화, 양성과정에서 교육내용과 그 수준에 대한 인증제도입, 사회복지현장실습의 체계화, 전문직 단체의 활성화 및 고유한 업무에 대한 전반적인 이해를전제로 한 대안의 필요성이 증대되고 있으며 복지정책 전반의 패러다임을 바꾸어야할 시기에 와 있다. 복지정책 전반을 이해하고 맞춤형으로 공급되는 인력으로 사회복지사의 업무 영역의 확대를 들 수 있으며 최근에는 기업·학교·군대·병원·교도소 등으로 활동영역이 확대되고 있으며 향후 사회복지사의 수요에 대한 정밀한 입안을 거쳐 복지정책의 전반적인 효율성을 높여야 할 것이다.

영문 초록

In modern society, structural absurdities, which are difficult to live by individual efforts, appear, and it can be seen as a social multi-polarization phenomenon of polarization with the gap between rich and poor. Given this realistic understanding, the question of what to do about the quality of an individual's life now emerges as a challenge. However, the reality is that as a basic right to guarantee the quality of institutional life as one of the ways to overcome or minimize my problems facing the structural limitations that individuals face in the process of overcoming these social, cultural and economic problems. The number of civil servants dedicated to social welfare in front-line institutions is also continually increasing, and is expected to increase further as the number of naturally occurring officials increases. The role of a social worker recognized universally varies according to the specialty and the characteristics of the social welfare institution or facility to which it belongs. In our society, the initial recognition of social workers tended to be perceived as unpaid or slightly paid as a service worker, but now we can feel a markedly different social status. What we intend to focus on in this paper has not yet been legislated, but through various discussions in the future, it is accompanied by recognition of the 'correction social worker' that makes it possible to recognize the need and smoothly support the correctional administration. It requires a forward-looking idea to discuss in detail and to collect various opinions In the future, strengthening legal qualifications considering the legal status of social workers and the characteristics of work, legalizing professional social workers, establishing a certification system for the content and level of education in the training process, systematizing social welfare field practice, revitalizing professional organizations, and unique The need for alternatives based on an overall understanding of work is increasing, and the time has come to change the paradigm of overall welfare policy. As a workforce that understands the overall welfare policy and is customized, it is possible to expand the work area of social workers. Recently, the field of activity has expanded to companies, schools, military, hospitals, prisons, etc. The overall efficiency of welfare policy should be increased through precise planning.
