국문 초록

2018년 4월 EU 집행위원회는 공익신고자에 대한 통일된 보호를 제공하기 위한 지침에 대한 법안이 제출되었으며 2019년 3월 회원국과 유럽 의회 간에 임시 합의가 이루어졌다. 이 지침은 2019년 12월에 지침 2019/1937로 채택되었다. 위원회는 프랑스, 헝가리, 아일랜드, 이탈리아, 리투아니아, 몰타, 네덜란드, 슬로바키아, 스웨덴, 영국(당시 회원국) 등 10개의 EU 회원국만이 공익신고자를 보호하기 위한 “포괄적 법률”을 가지고 있다고 밝힌 바 있다. 한편 이 지침은 2021년 12월 17일까지 국내법으로 전환되어야 했으며, 대부분의 EU 회원국은 이 기한을 지키지 못했다. 지금까지 덴마크, 스웨덴, 포르투갈, 키프로스, 리투아니아, 몰타, 라트비아, 크로아티아, 아일랜드, 프랑스만이 본 지침을 국내법으로 도입 전환하였다. 본 지침의 주요 내용은 다음과 같다. ￭ 직원이 50명 이상인 조직은 적절한 내부신고 채널을 구축해야 한다. ￭ 공익신고자는 온라인 시스템, 우편 또는 전화 핫라인이나 자동 응답기를 사용하여 구두로 신고할 수 있어야 한다. 회사는 사용된 채널에 관계없이 공익신고자의 신원이 비밀로 유지되도록 해야 한다. ￭ 모든 개인 데이터는 GDPR에 따라 처리되어야 한다. ￭ 조직은 내부적으로 신고를 받고 후속 조치를 취할 적절한 담당자를 지정해야 한다. ￭ 신고 접수는 7일 이내에 신고자에게 확인되어야 하며, 3개월 이내에 조치가 취해진 경우에는 내부 조사 상황 및 결과를 신고자에게 알려야 한다. ￭ 회사는 내부신고 프로세스 및 해당 기관에 대한 신고 채널에 대한 정보를 제공해야 한다. ￭ 신고 절차를 방해하는 기업에 대해 벌칙을 부과하는 제재 조치가 포함되어 있으며 공익신고자의 신원을 비밀로 하지 않거나 사업주가 보복하는 경우에도 마찬가지이다. 한편 EU 공익신고자보호지침은 EU 전역의 공익신고자에 대한 공통의 최소 보호 기준을 제공하는 것을 목표로 하고 있다. 추후 회원국들의 충실한 EU 공익신고자보호지침의 도입 및 전환을 통해 건전한 기업문화의 필수요소인 투명성과 신뢰라는 긍정적인 이미지가 조성되기를 기대한다.

영문 초록

In April 2018, the EU Commission launched a proposal for a directive aimed at providing uniform protection for whistleblowers and a provisional agreement was reached between member states and the European Parliament in March 2019. It was adopted as Directive 2019/1937 in December 2019. Before the process kicked off, the Commission stated that just 10 EU member states - France, Hungary, Ireland, Italy, Lithuania, Malta, the Netherlands, Slovakia, Sweden and the UK (then a member state) had some form of “comprehensive law” protecting whistleblowers. The Directive had to be transposed into national law by 17 December 2021, a deadline that most EU member states failed to meet. So far only Denmark, Sweden, Portugal, Cyprus, Lithuania, Malta, Latvia, Croatia, Ireland and France have transposed it into national law. In addition to the important aspects of the Directive are as follows: ￭Organisations with more than 50 employees are obliged to establish suitable internal reporting channels ￭Whistleblowers should be able to submit reports in writing via an online system, by post or orally through the use of a telephone hotline or answering machine system. Companies have to ensure that the identity of the whistleblower is kept confidential regardless of the channel used. ￭All personal data must be handled in accordance with the GDPR ￭Organisations must designate a suitable person to receive and follow up on reports internally ￭Receipt of the report must be confirmed to the whistleblower within seven days while he or she must be informed of any action taken within three months, as well as the status of the internal investigation and its outcome ￭Companies are required to provide information on the internal reporting process as well as on the reporting channel(s) to the respective authority. ￭Sanctions are included whereby companies obstructing the reporting procedure will face penalties. The same applies to a failure to keep the whistleblower’s identity confidential or retaliatory action by the employer The EU Whistleblowing Directive aims to provide common minimum standards of protection for whistleblowers across the EU. In addition, taking Through the introduction and transition of EU Whistleblowing Directive in Member States allows a company to create a positive image of transparency and trust, an essential element of a healthy corporate culture.
