북한인권의 현실성과 문제점

국문 초록

국제적으로 북한 인권문제의 심각성이 공론화 되는 가운데 금년 11월 유엔총회에서 ‘북한인권 결의안’이 통과되었고, 이어 서울 ‘북한 인권국제대회’(2005.12)를 통해 북한 인권문제가 국제레짐의 관심사항으로 부각되었다. 국제사회가 지적하는 북한의 인권유린 실태는 심각한 고문과 모멸적인 징벌, 정치범수용소 운용, 강제 실종된 납북자와 국군포로의 생사확인과 송환 거부, 연좌제와 공개처형, 성매매와 낙태의 강요 등으로 요약된다. 아울러 한국정부에 대해서는 북한 인권에 대한 적극적 개입과 개선을 촉구하고 있다. 그런데 탈냉전 이후 국제 인권레짐에서는 인권에 대한 새로운 개념 즉 ①인권관련 각국의 주권을 절대적이지 않으며 ②인권을 심각히 침해 할시 외부의 개입은 정당화 될 수 있다는 견해이다. 특히 미국은 심각한 인권침해 혹은 인신매매를 근절하지 않는 국가에 대해서는 다양한 제재조치가 가능토록 법적으로 명시하고 있다. 이런 점에서 북한 인권문제는 남북한 간 문제가 아니라 국제적인 문제로 규정된다. 반면에 북한은 인권문제 제기를 단지 ‘제국주의자의 사상 문화적 침투, 심리모략전, 반동적 사상독소 등 규정하거나 내정간섭이라고 반발하고 있다. 그러나 북한 인권문제는 기본적 생존권의 문제로서 국제사회의 대북인권 개선 요구와 우리의 대북정책을 적절히 결합시키는데 있다. 우리가 취할 대북 인권기본정책은 정당성과 도덕성 국제규범을 견지하는 것, 재외탈북자들의 신변보장과 주변국들이 일시적 피난처를 제공토록 외교력을 집중하는 것, 국군 포로와 납북자 문제를 우선 해결하는 것, 인도적 관심과 국제사회에서의 인권외교를 강화하는 것 등이다. 아울러 북한 인권문제와 관련한 향후 전망을 해보면 첫째 국제레짐에서 북한 인권 개선 요구와 압력이 계속 강화될 것, 둘째는 미국과 세계인권단체들이 북한의 정권진화(regime evolution)를 계속 추진하게 될 것, 셋째는 북한은 나름대로 국제인권규범을 지킨다고 하면서 정권유지 범위 내에서 선별적으로 수용해 나갈 것. 넷째는 국내 진보정당 내지 좌파적 사회력들은 대북 접촉을 강화하면서 북한 인권문제를 ‘내재적 접근’을 통한 해결해 나가려고 할 것이다.

영문 초록

North Korean Human Rights issues have been constantly raised internationally for last over 10 years, specially by UN, EU and US by adopting of “Resolution on North Korean Human Rights” by the UN General Assembly and by holding the “Seoul Summit: Promoting Human Rights in North Korea” both in 2005. Humiliation with torture and punishment, imprisonment of political offenders, no freedom of religion and conscience, rejection of confirmation of survival status of Korean war abductees to N. Korea and war prisoners, implicative system, public execution, women trafficking and sexual slavery and forced abortion are being reported as the reality of infringement of Human Rights in N. Kroea. After the cold war era, the international Human Rights Regime proposes the new concept of Human Rights; the sovereignty of each nation is not supreme as long as it's concerned Human Rights; the external intervention can be justified when Human Rights are seriously violated, which means that external power is needed to protect the lives of people and to keep the peace under a certain circumstances. Specially, the US clearly states in its law that they can sanction the nations when the nations are seriously violating the human rights and continuing human trafficking. N. Korea's repels against these Human Rights issues saying that is the interference in the domestic affairs in N. Korea, the invasion of imperialists' culture and idea, self-righteousness and psychological intrigue of the US. In reality, the social welfare and the social security system pursued by DPRK Socialism is nothing but a fiction and the international request to improve the Human Rights policy is not the interference of the domestic affairs in a country as the Human Rights is the universal value. Therefore, N. Korea needs to take action to improve the Human Rights such as joining the international Human Rights organization and observing its regulations, revising the laws and systems, considering the return of Korean War abductees and allowing the visit to N. Korea of international Human Rights organization. Also South Korea needs to harmoniously combine the N. Korean policies with the international Human Rights request. The Human Rights policy we need to have against N. Korea is to adhere to and observe the morality and international regulations. Also working on the diplomatic level to offer the shelter and to ensure the security to N. Korean defectors is needed along with reinforcing the Human Rights diplomacy in international society. Lastly, the prospects for the Human Rights issue in N. Korea are; the international requests and pressure will be increasing under international regime; international Human Rights organization together with US will keep pursuing the regime evolution in N. Korea; N. Korea will selectively accept the international request to protect their regime and power insisting to observe the international regulations; S. Korean progressive parties and leftists will try to intensify the contact with N. Korea and to solve the problem with the N. Korea's internal standard and approach.
