국문 초록

본 논문은 6·25전쟁 국군포로문제의 현황과 해법을 분석하기 위한 것이다. 1953년 체결된 정전협정에 따라 전쟁포로 송환이 이루어졌으나, 수많은 국군포로들이 송환대상에서 제외되어 오늘날 북한에 억류된 채 남아 있다. 6·25전쟁 국군포로문제는 국가가 국군포로 송환에 필요한 모든 수단을 동원하여 반드시 해결되어야 할 사안이다. 그러나 역대 정부로부터 현 정부에 이르기까지 우리정부는 국군포로문제를 해결하는데 제대로 된 성과를 얻어내지 못했다. 가장 큰 이유는 북한당국이 아예 국군포로의 존재조차 인정하지 않고 있기 때문이다. 주지하는 바와 같이, 고령의 국군포로 당사자들 가운데 이미 상당수가 사망하였으며, 생존자들도 수명연한이 얼마 남지 않은 상황이다. 더욱이 국군포로들은 북한체제의 전체주의적 속성으로 인해 인권적으로도 매우 열악한 상황에 처해 있는 것으로 파악되고 있다. 이는 당사자와 가족의 고통을 염두에 두고 볼 때, 정부가 인도주의적 차원에서 반드시 해결해야 하는 이유이다. 전쟁피로자(포로)나 피납자가 그 원래 소속국가로 송환되는 것으로 즉, ‘제자리’로 복귀하는 것은 인권의 회복이며 그렇게 되도록 노력하는 것은 국가의 책무이자 국가이성의 발현이 아닐 수 없다. 우리는 북한에 생존해 있는 국군포로의 생사확인, 가족상봉, 송환문제해결, 제3국으로 탈 북한 국군포로와 가족의 안전한 송환, 귀환한 국군포로의 안정적인 정착지원 등 국군포로가 처한 상황에 맞는 해결책을 강구해 나가야 할 것이다. 아울러 북한 지역에 있는 국군유해발굴사업도 지속적으로 추진해 나가야 할 것이다.

영문 초록

This paper is to analyse to the current situation and future solution of ROK(South Korea) prisoners of wars(POWs) from the Korean War. The issue of ROK POWs were repatriated in accordance with the Armistice Agreement signed in 1953. Yet numerous ROK POWs still remain detained in North Korea as they were excluded from the repatriation list. The issue of ROK POWs is an inescapable problem that must be solved. The ROK Governments after the Korean War have failed to resolve the POW issue. Needless to say, North Korea do not acknowledge at all the existence of South Korean POWs. As everyone knows, significant numbers of the aged POWs have already died, even the survivors‘ life has a few years. Moreover, the POWs are in a very poor human rights situation, because of the nature of the North Korean totalitarian regime. This is the reason why the POWs issue must get solved in a humanitarian way, considering the pain of the interested parties and their families. To return war prisoners and abductees to their countries is part of their human rights and to do so is an obligation of the nation and the manifestation of its 'national reason.' We have to do our best to seek appropriate solutions that befit the situations of individual ROK POWs by confirming their survival or death, arranging families reunions, addressing repatriation issues, helping ROK POWs and families who defected from North Korea to third countries safely arrive at the South, or overseeing the comfortable settlement of repatriated POWs in South Korea. In addition, we have to push forward with the remains recovery of ROK service members buried in North Korea.
