국문 초록

본 연구는 사회상규 조항의 운용을 적정화 할 방안을 모색하는 것을 목표를 설정한 후, 그간 축적된 우리 학계의 논의와 판례를 정밀하게 고찰하고, 거기에 약간의 아이디어를 보태어, 사회상규 조항 운용의 적정화 방향을 제안해 보았다. Ⅱ에서는 사회상규 조항의 입법 경위를 개관하여, 엄격한 운용의 예에 가까운 지점에서, 수범자가 가벌성을 예견하고 가벌성에 공감 할 수 있는 방향으로, 동 조항을 운용해야 함을 논증하였다. Ⅲ에서는 사회상규 조항에 관한 학설과 판례를 일별하여, 사회상규 조항 운용의 일탈상, 즉 유사한 사안에 다른 기준 적용하기, 같은 기준을 적용하여 다른 결론 내리기, 논증 생략하기 등의 문제가 현재까지도 잔존하고 있음을확인하고, 그간 이루어진 개선론의 의의와 한계를 짚어보았다. Ⅳ에서는 이상의 논의를 종합하여, ① 일반요건 열거형의 사용을 최소화하고, 다섯 가지 요건의 관계를 재설정하기, ② 개별요건 제시형을 적극 활용하고, 개별요건을 적정화해 나아가기, ③ 사회상규 심사의 기준을 실증적 방법으로 검증하기, ④ 사회상규 심사의 각 요건을누락 없이 분설함으로써 치밀하게 논증하기, ⑤ 기준의 적용에 관한 메타 규칙 마련하기 등을 제안하였다. 결론에서는 연구의 의의와 제약점을 설명하였다.

영문 초록

Under the aims to find appropriate application methods of the Criminal Act Article 20 ‘Social Rules’ clause, this study explored previous studies and judicial precedents, and suggested improvement methods on application of the clause. In chapter Ⅱ, the standards that ‘Social Rules’ clause should be used at close point from the rigid applications and by ways people can predict and agree the illegality and punishment were demonstrated. In chapter Ⅲ, based on previous studies and judicial precedents, deviations of applications of the clause were identified: different standards on similar cases, different conclusions from same standard, omitting demonstrations. In chapter Ⅳ, improvement methods on application of the clause were suggested: ① reducing use of general requirements standard, and reformulating the relations between five requirements in it, ② increasing use of individual requirements standard, and optimizing the requirements in it, ③ veryfying the standard on ‘Social Rules’ clause by empirical methodologies, ④ demonstrating the illegality and punishment elaborately by separate explanations on every requirements of the standards, ⑤ introducing the meta rules on application of the standards. In the conclusion, meanings and limitations of the study were discussed.
