국문 초록

본 연구 목적은 북한의 헌법에 나타난 사회복지 정책 관련 내용을 추적하여 정책적 변동을 규명하는 것이다. 본 연구의 대상과 범위는 북한 정권수립부터 현재까지 모두 열 차례개정된 북한 헌법이다. 이는 시간적 범위로 1948년 정권수립 당시 최초 헌법부터 2019년현재 헌법까지를 의미한다. 본 연구방법은 북한 헌법을 문헌연구방법 중심으로 분석하였다. 분석결과, 북한은 최초 1948년 헌법에서 2차 헌법인 1972년 헌법 사이에서만 입장이크게 변화하였을 뿐, 그 이후에는 뚜렷한 변화가 없었다. 무엇보다 중요한 것은, 북한이약 50년 동안 거의 동일한 입장을 왜 유지해왔느냐, 그러한 배경과 근거가 무엇이냐이다. 이를 정리하면 첫째, 무엇보다 북한의 복지 인식과 프레임의 기본적인 속성과 그로 인한한계에 기인한다. 이는 북한이 갖는 국가사회복지체제의 완결성 혹은 우월성에 대한 맹신적 인식과 자세를 의미한다. 둘째, 북한의 입장에서 만약 체제 내의 복지확장을 시도할경우 기존의 한계를 일부 인정하고 시정해야 한다. 그러나 이러한 과정에서는 반드시 북한체제 자체의 건설적이고 자정적 비판이 전제된다. 셋째, 두 번째 문제의 연장선상에서 사회복지의 경우 무엇보다 북한은 통치자의 업적으로 인식하고 있다. 이러한 환경하에서 새로운 정책적 대안을 제시한다는 것은 기존과 현존하는 통치자에 대한 사실상의 도전행위이다. 넷째, 세 번째 문제의 연장선상에서 헌법의 주요 내용은 종국에는 통치자만이 수정할수 있고, 통치자의 허락이 전제되는 것이 북한체제의 특징이다. 이러한 점에서 접근하면장기간 유지된 복지인식의 변화와 확장의 권한과 결정은 결국 통치권자의 고유권한이다. 따라서 이러한 이유로 북한은 1972년 이후 지금까지 기존의 체체를 유지할 수밖에 없었다.

영문 초록

The purpose of this study is to identify policy changes by tracking social welfare-related clauses in North Korea's constitution. To achieve this, this research reviews the North Korean Constitution, which has been amended ten times since the establishment of the North Korean regime in 1948. The constitution is analyzed by the literature review method. North Korea's position on social welfare changed significantly only between the first constitution of 1948 and the second constitution of 1972, but there was no significant change after that. Based on this fact, this paper is focused on the reason why North Korea hasn’t changed their social welfare policy for about 50 years and what the rationale is, and the background for it. In this paper, four reasons are considered. First, it is due to the basic nature of North Korea's concept of welfare, and the limitations rooted in the blind belief that their social welfare system is superior and complete. Second, expansion of the social welfare system in the constitution would imply acceptance that there is a flaw in their current constitution. However, ratifying an amendment would require acknowledgment of such a flaw by the North Korea regime itself, which they are unwilling to give. Third, extending from the second reason, the social welfare system is especially considered to be an achievement of the North Korean supreme leader, and changing the social welfare policy could be considered contradictory to the perception of the success of these policies. Fourth, as an extension of the third reason, North Korea’s constitution can only be changed by the leader or under the leader’s permission. It is therefore the leader's sole right to change or expand the social welfare system in the constitution. Because of these reasons, North Korea has not been able to change the social welfare system in the constitution in the years since 1972.
