조력존엄사와 관련된 연명의료결정법 일부개정 법률안의 문제점과 그 개선방안

국문 초록

우리나라에서 생애의 종기에 자신의 죽음에 대한 자기결정권을 행사할 수 있는현행법상의 제도로 호스피스·완화의료 및 임종과정에 있는 환자의 연명의료결정에관한 법률에 의한 호스피스와 연명의료 중단등 결정이 존재한다. 이러한 제도에 더하여2022. 6. 15. 안규백 의원의 대표발의로 연명의료결정법의 일부개정 법률안이 발의되면서, 의사의 조력을 받아 환자 스스로 자신의 삶을 종결할 수 있도록 하는 ‘조력존엄사’ 제도를 도입할 것인지 여부가 사회적으로 논의가 되고 있다. 하지만 연명의료결정법의 개정을 통하여 연명의료 대상인 의학적 시술의 범위 및 연명의료계획서 작성시기를 확대하고 호스피스 환자의 연명의료중단 등 결정 절차를 완화하기도 하였지만, 여전히 연명의료결정법상의 연명의료중단과 관련된 제반 절차가 아직까지 국민들에대하여는 활성화되지 못하고 있으며 각각의 제도적 구별점에 대하여도 환자와 의료진모두 정확히 인지하지 못한 실정이다. 본고에서는 의사 조력 자살에 해당하는 조력존엄사와 관련된 개념을 구별하고형법상 자살방조죄와의 관계와 외국의 논의를 살펴본 뒤, 개정 법률안이 환자의 자기결정권을 충분히 보호하고 있는지 및 조력존엄사 절차의 이행과 관련된 문제는 없는지 등을 검토하여 우리나라 법제의 개선 방향을 고찰하고자 한다. 특히 존엄한 죽음을위하여 의사 조력 자살 제도가 사회적으로 충분한 논의를 거쳐 법적 공감대를 형성하는 것을 전제로 한다면, 개정 법률안에서는 조력존엄사를 신청한 환자의 자기결정권을 충분히 보호하기 위한 법적 장치인 담당의사의 설명의무와 환자의 신청 철회보장을 명문화하여야 할 것이고, 조력존엄사 대상자 결정에 있어서 담당의사의 개입을통하여 환자의 상태를 정확히 파악할 수 있도록 절차를 보완하여야 할 것이다.

영문 초록

In Korea, people are allowed to exercise their right to self-determin ation over their own deaths at the end of their lives under the Hospice, Palliative Care, and Patient Life-sustaining Treatment Decisions Act, su ch as suspension of hospice and life-sustaining treatment. In addition t o these systems, a partial amendment to the Life-sustaining Treatment Decision Act was proposed at the representative suggestion of Rep. Ah n Kyu-baek on June 15, 2022, and it is socially discussed whether to introduce an 'assisted suicide with dignity' system that allows patients to end their lives with the help of doctors. Under the current law, thro ugh revision, expanded the scope of medical procedures subject to life -sustaining treatment and the timing of drafting a life-sustaining treat ment plan, and eased the decision-making process, such as the termina tion of life-sustaining treatment for hospice patients. Nevertheless, the current law is still not activated, and both patients and medical staff ar e not accurately aware of the system. All procedures related to the su spension of life-sustaining treatment have not yet been activated for t he people, and each institutional distinction has not been accurately rec ognized. In this paper, we will distinguish the concept of assisted suicide with d ignity, examine the relationship with the crime of assisted suicide unde r the criminal law, and examine whether the revised bill sufficiently pr otects the patient's right to self-determination and whether there are p roblems related to the implementation of assisted suicide procedures. In particular, if the physician-assisted suicide system for a dignified deat h is premised on forming a legal consensus through sufficient social dis cussion, the amended bill should stipulate the explanation duty of the a ttending physician and the guarantee of withdrawal of the patient's appli cation, which are legal devices to fully protect the self-determination o f patients who have applied for assisted death. Also, in determining the recipients of assisted death with dignity, the procedure should be suppl emented so that the patient's condition can be accurately identified thro ugh the intervention of the doctor in charge.
