국문 초록

지난 대선 당시에 유력 후보들은 입을 모아 5･18정신을 헌법 전문(前文)에 넣겠다고 공약하였다. 그러나, 대통령선거가 끝나고 아직까지는 5･18정신의 헌법 전문 수록을 위한 개헌논의가 정치권에서 본격적으로 시작되고 있지 않다. 본 연구는 5･18의 헌정사적･헌법적 가치를 규명하여 5･18의 민주주의 정신이 헌법전문에 수록되어야 하는 이유를 알아보는 것을 연구의 목적으로 삼는다. 이를 위해 본 논문에서는 헌법 전문의 의의, 세계 각국의 헌법 전문의 규정 형태 및 규정 내용, 헌법 전문의 법적 효력, 현행헌법 전문의 주요 내용과 역사적 사건들, 5･18을 헌법전문에 수록하려 했던 기존의 시도들을 살펴보고 5･18의 헌정사적･헌법적 가치를 규명해본 후, 결론부에서 5･18정신의 헌법전문 수록의 의미를 알아본다.

영문 초록

In the last Presidential election, almost all the promising candidates pledged themselves to amend the spirit of 5･18 into the preamble of Korean Constitution. However, after the election and so far, the discussion for the constitutional amendment has not even started among the politicians. This paper aims at examining the reason why we should amend the democratic spirit of 5･18 into the preamble of Korean Constitution by exploring the constitutional and historical value of Gwangjoo Democratization Movement. To achieve the aim, this paper will examine the meaning of the preamble of the constitutional law, types, contents and legal effect of the constitutional preambles in major countries in the perspective of comparative constitutional law. Then, it will delve into the contents and historical events in current Korean Constitution and overview the tries to amend the spirit of 5･18 into the constitutional preamble in the past and explore the constitutional and historical value of Gwangjoo Democratization Movement. In conclusion, this paper will conclude the meaning to amend the spirit of 5･18 into the preamble of Korean Constitution.
