국문 초록

한국에서 비전문 외국 인력의 도입은 경제의 급속한 성장과 글로벌화의 수요이자 고학력화로 인하여 3D산업의 노동력이 부족한 현상을 완화하기 위하여 시작되었다. 외국인 근로자의 대량 유입으로 인하여 한국에서의 외국인 근로자에 대한 노동권, 인권 침해 문제는 날이 갈수록 심각해지고 있고 이는 앞으로 한국이 직면하게 될 중요한 사회문제로 될 것이다. 1985년 제40차 유엔총회에서 채택된 ‘체류국의 국민이 아닌 개인의 인권에 관한 선언’ (Declaration on the Human Rights of Individuals Who are not Nationals of the Country in which They Live; 외국인 인권선언)에 따라서 사업장에서 근로는 제공하고 있는 노동자는 국적과 상관없이 동등한 대우를 받아야 한다. 하지만 현재 한국의 행정 관행상 외국인 근로자는 여전히 사각지대에 존재하고 있으며, 이들의 노동권과 보편적 권리가 충분히 보장되고 있지 않다. 2000년대에 들어 외국인 근로자의 수가 급증하고 있는 한국 사회의 현실에서 이들과 어떻게 공존할 지는 사회의 향후 잠재적 관심사가 될 것으로 보인다. 한국에서의 외국인 노동자에 대한 노동권 및 인권 침해 문제는 한국의 관련 법률 제도가 미비하여 발생한 것으로 보인다. 특히 한국에서 외국인 노동자는 “외국인”과 “노동자”가 가지는 전반적인 노동인권 문제의 대상이다. 본 연구는 한국이 외국인 노동자에 대한 대우 문제에 초점을 두고 재한 외국인 노동자의 노동권익을 보장하는 관점에서 관련 법률 제도를 연구하고자 한다. 이를 위하여 본 연구는 노동권과 인권 차원에서 한국의 외국인 근로자에 대한 전체적인 관련 법률 제도를 세분화하여 연구하였다.

영문 초록

In South Korea, the introduction of non specialized foreign manpower is to alleviate the demand of rapid economic growth and globalization as well as the shortage of labor force in 3D industry due to high education. With the influx of foreign workers, the labor rights and human rights of foreign workers have been seriously violated in South Korea, which will become an important social problem in the future. On the labor rights and human rights violations of foreign workers in South Korea, it is because the relevant legal system of South Korea is not perfect. In particular, in South Korea, foreign workers are "foreigners" and "workers" with the overall labor human rights issues. This study focuses on the treatment of foreign workers in South Korea, and discusses the relevant legal system from the perspective of protecting the labor and universal rights of foreign workers in South Korea. Therefore, from the perspective of labor rights and human rights, this study will subdivide the overall legal system of foreign workers in South Korea.
