국문 초록

경찰청에서는 2022년 2월부터 100일간 ‘산업기밀 유출 사범 특별단속’을 실시하였다. 이렇듯 정부에서는 산업기밀 유출을 막고 기업을 보호하기 위해 노력하고 있으나, 산업기밀 유출범죄는 줄지 않고 오히려 증가하고 있다. 산업기밀 유출범죄 처벌 현황을 살펴보면 법정형에 비하여 선고형이 지나치게 낮다는 것이다. 산업기밀 유출 사건 사례를 통해서도 확인했듯이 실제 선고형은 징역 2년 이상이 선고되는 경우는 드물며, 이마저도 대부분 집행유예와 같이 선고된다는 점이다. 또한 산업기밀유출 피해는 주로 중소기업에 집중되어 있다. 2022년 경찰청 자료에 의하면 중소기업 피해는 78%이며, 대기업 피해는 22%로 확인되었다. 이러한 문제의식 하에, 산업기밀 유출실태 및 사례분석을 한 후에 몰수제도 활용방안을 비롯하여 피해 중소기업 보호방안 강구, 체계적인 수사 시스템 도입 등 필요성에 대해 제언하였다.

영문 초록

The National Police Agency conducted a “special crackdown on criminals leaking industrial secrets” for 100 days from February of this year. As such, the government is trying to prevent the leak of industrial secrets and protect companies, but the crime of leaking industrial secrets is increasing rather than decreasing. If you look at the punishment for the crime of leaking industrial secrets, the sentence is too low compared to the statutory sentence. As confirmed by the case of the leak of industrial secrets, the actual sentence is rarely more than two years in prison, and even this is mostly sentenced with probation. In addition, the damage caused by the leakage of industrial secrets is mainly concentrated in small and medium-sized enterprises (SMEs). According to the data of the National Police Agency in 2022, damage to small and medium-sized enterprises was 78%, and damage to large enterprises was confirmed to be 22%. Based on this awareness of the problem, after analyzing the situation and case studies of industrial secret leaks, the necessity of using the confiscation system, devising measures to protect SMEs from damage, and introducing a systematic investigation system was suggested.
