국문 초록

고도의 정보화 사회로 진입한 현대사회에 있어서 사이버공간의 중요성은 아무리 강조하여도 지나침이 없다. 그럼에도 사이버공간에 대한 법률적 인식과 취급은 1990년대를 벗어나지 못하고 있는 것으로 보인다. 이러한 경향은 형사법의 영역에서 특히 두드러지는데, 1995년 형법개정 이후 아직까지 이 분야의 커다란 변화는 발견되지 않고 있기 때문이다. 이 글은 정보화 사회에서의 형법적 대응과 관련하여 해킹행위에 대한 형사법적 대응을 주요한 내용으로 한다. 해킹은 사이버범죄를 실행하는 수단 전반을 지칭하기도 함에도 아직 이와 관련한 법률적 정비가 부족하다는 문제인식에 이 논의의 출발점을 찾을 수 있다. 이 주제를 검토하기 위하여 구체적으로 ① 해킹의 유형과 그 의미에 대하여 살펴보았으며(Ⅱ), ② 현행법상 해킹행위에 대한 형사처벌의 가능성과 그에 따른 문제점을 개관하였다(Ⅲ). 그리고 이러한 논의를 바탕으로 ③ 독일형법상 해킹행위와 관련된 규정을 검토하고 해킹행위에 대응한 형사법의 정비방향에 대한 나름의 생각을 제시하였다(Ⅳ).

영문 초록

Although the importance of cyberspace cannot be overemphasized in the modern society that has entered a highly information-oriented society, the legal recognition and handling of cyberspace does not seem to have escaped from the 1990s. This trend is particularly conspicuous in the area of criminal law, since no significant changes have been found in this field since the revision of the criminal law in 1995. This article mainly deals with the criminal law response to hacking in relation to the criminal law response in the information society. Although hacking refers to the overall means of executing cyber crimes, the starting point of discussion is based on the awareness that there is still a lack of legal arrangements in this regard. In order to examine this topic, ① types and meanings of hacking were examined in detail(II), and ② possibilities of criminal punishment for hacking acts under the current law and their problems were reviewed(III). And based on this discussion, ③ reviewed the regulations related to hacking under the German Criminal Act and presented own thoughts on the direction of the revision of the criminal law in response to hacking(IV).
