자율주행자동차와 경찰활동에 관한 소고

국문 초록

기업과 자동차 제조업체는 자율주행자동차 개발을 위해 많은 자본과 연구에 집중적으로 투자하고 있으며, 이는 향후 수십 년 동안 주류가 될 것이다. 자율주행자동차는 잠재적으로 인력중심의 자동차 운행을 대체할 것이며, 신기술들은 교통 관련 법률이나 정책 및 교통치안활동을 변화시킬 것이다. 따라서 본 연구에서는 자율주행차의 활동 변화와 교통치안에 대해 다음과 같이 논의하였다. 먼저, 교통치안활동에서 일반 시민들과 가장 많이 접하는 교통검문에 변화가 있을 것이다. 다만 자율주행차와 경찰활동 간의 창의적 활동을 고려할 때 교통경찰의 개입은 지속적으로 이루어질 것이다. 둘째, 자율주행차에 탑재된 전자적 센서는 다른 차량이나 사람과의 충돌을 방지할 수 있어 경찰 치안활동의 위험성을 줄일 수 있다. 셋째, 자율주행차는 운전면허증을 불필요하게 만들 수 있고, 인간 운전자가 자율주행차를 조종할 필요가 없다면 운전면허증을 요구하지 않아도 되는 결과를 예상할 수 있다. 게다가 경찰이 무면허 운전자에게차량에서 하차하게 하거나 무면허 운전자 단속 및 체포를 요구할 근거가 없다. 넷째, 자율주행차가 음주운전자나 승객을 태울 수 있다면 공공의 안전을 위협하는 음주운전을 금지하거나 경찰이 음주운전을 단속하고 수사할 근거가 약하게 된다. 그러나 자율주행차의 방향과 기술의 발전에 따라 다양한 법적 딜레마가 발생하며 이에 대한 의문이 제기될 수 있다. 그럼에도 불구하고, 경찰은 법학자와 기술자 등 다양한 분야의 전문가들과 자율주행차의 교통치안 방향에 대해 진지하게 논의해야 한다. 결국 이러한 논의는 자율주행자동차의 기술과 경찰의 치안활동 그리고 일반 시민들에게 상호 이익이 되는 방향으로 계속 발전할 수 있을 것이다.

영문 초록

In Companies and automobile manufacturers are investing a lot of capital and research to develop self-driving cars, and self-driving cars will become mainstream in the next decades. Self-driving cars will potentially replace human-powered cars, and new technologies will change traffic-related laws, policies, and traffic security activities. Therefore, this paper discussed the changes in the activities of autonomous vehicles and traffic security as follows. First of all, in traffic security activities, there will be a change in traffic inspection that comes into contact with ordinary citizens the most. However, considering the creativity between self-driving cars, self-driving cars, and self-driving cars and police activities, traffic police intervention will continue. Second, since sensors mounted on autonomous vehicles can prevent collisions with other vehicles or people, the risk of police in security activities can be reduced. Third, self-driving cars can make driving licenses unnecessary, and if human drivers do not have to control self-driving cars, they will not have to ask for a driver's license. In addition, there will be no grounds for the police to demand a driver with an invalid driver's license to leave the vehicle, crack down on or arrest an unlicensed driver. Fourth, if self-driving cars can transport drunk drivers or passengers, the grounds for banning drunk driving that threatens public safety or for police to crack down on drunk driving and investigate will be weak. However, various legal dilemmas arise according to the direction of the autonomous vehicle and the development of the technology, and there may be questions about this. Nevertheless, the police should seriously discuss the direction of traffic security for autonomous vehicles with experts in various fields, including jurists and technicians. Eventually, these discussions can continue and develop in a direction mutually beneficial to free driving technology and police and ordinary citizens.
