국문 초록

북한은 체제적 폐쇄성으로 인하여 인권문제에 관한 한 사각지대라고할 수 있다. 그 동안 여야 대립으로 국회에 계류 중인 북한인권법안이1년 2개월 만에 법제사법위원회에 다시 상정되었다. 그러나 동 법안에대한 근본적인 시각차로 인하여 첨예한 대립과 공방으로 표류되고 있는것이 현실이다. 북한인권법에 대한 취지는 한 국가의 주권을 초월한 보편적 가치라는 인식에 바탕을 두고 있다는 점에서 접근하여야 한다는것이다. 미국과 일본은 2004년과 2006년 북한인권법을 제정하여 통과시킨 사례로 보아 이제는 우리 정부가 북한인권법을 제정하여 북한 인권 개선과 인권 침해 사례 등을 기록하고 연구할 수 있는 북한인권재단과 기록보존소를 설치 운영하여야 할 시점에 와 있다는 것이다. 본 논문에서는 북한인권법의 현실적 문제가 무엇이고 이를 개선하기 위한 방안은 어떠한 것이 있는가를 중심으로 북한인권법을 해부하고자 하는 목적과 동기를 가지고 작성되었다. 본 논문에서는 먼저 인권의 기본적인개념과 북한인권법을 설명하고, 미국과 일본의 북한인권법의 사례를 중심으로 득과 실을 분석한 후 북한인권법의 문제점을 바탕으로 북한인권법이 나아갈 향후 방향을 조명해보고자 한다.

영문 초록

The human rights record of North Korea is extremely hard to fully assess due to the secretive and closed nature of the country. The North Korean Human Rights Act proposed by the ruling Grand National Party has hit a critical deadlock. After passing the Foreign Affairs, Trade and Unification Committee at the National Assembly in February, the bill is waiting for discussion in the Legislation and Judiciary Committee, which is responsible for examining its legal aspects and wording. The latter committee then submits the act to the full National Assembly. We are deeply worried at the way our lawmakers are attempting to insert clauses on economic assistance into the original bill. The act is based on a consensus that human rights are protected by the United Nations’ Universal Declaration of Human Rights. The United States and Japan passed their own versions of a North Korean human rights act with unanimous agreement between ruling and opposition camps. Our North Korean human rights act stipulates what the government should do: Establish a foundation and a national archive to collect, register and preserve all evidence of the North Korean regime’s human rights abuses. The bill also includes a clause that permits civic groups to provide aid to the North.
