국문 초록

본 연구는 개별불부합지 관련 제도 및 연구자료 등을 조사·검토하여 집단불부합지와 개별불부합지를 명확히 구분·정립한 후 개별불부합지의 정리방안을 제시하는 것이 목적이었다. 연구목적을 달성하기 위해 시간적 범위는 2012년부터 현재까지로 하며, 공간적 범위는 우리나라로 한정하고, 내용적 범위는 개별불부합지를 정의하고, 현행 지적재조사 행정절차를 토대로 개별불부합지 정리방안을 동의서 징구, 이의신청, 조정금 세 가지로 구분하여 제시하였다. 연구결과, 첫째, 개별불부합지에 대한 지적재조사의 동의요건을 토지소유자 4분의 1로 완화하는 방안을 제시하였고, 둘째, 경계확정에 대한 이의신청 기간을 30일 이내로 단축하는 방안을 제시하였으며, 셋째, 경계확정에 따른 단순 경계정정이나 법정 허용오차 내에서의 면적증감은 별도의 조정금 없이(불가항력적으로 과도하게 허용오차를 초과했을 경우 별도의 구제책 마련) 추진하는 방안을 제시하였다.

영문 초록

The objectives of this study were to clearly distinguish and establish the group cadastral non-coincidence and the individual cadastral non-coincidence by examining and reviewing the systems and research data related to the individual cadastral non-coincidence and present the way of resolving the individual cadastral non-coincidence. The temporal range of this study was from 2012 to the present. Moreover, the spatial range of this study was limited to South Korea. The content range was defined as the individual cadastral non-coincidence. Based on the current cadastral resurvey administrative procedure, the individual cadastral non-coincidence resolution measures were presented in three steps: request for consent, objection, and adjustment money. The results of this study proposed (1) to ease the consent requirement for the cadastral resurvey regarding the individual cadastral non-coincidence to one-fourth of the land owners, (2) to shorten the period for objection to the boundary determination to less than 30 days, and (3) to promote a simple boundary correction due to boundary determination or area increase or decrease within legal tolerance without separate adjustment money(a separate remedy should be prepared when it exceeds the tolerance excessively by force majeure).
