지적행정에서 국민의 권리구제 방안 연구

국문 초록

본 연구는 국민의 지적행정 관련 불편 해소를 위한 권리구제 제도로 지적위원회(지적측량 적부심사), 국민권익위원회(고충민원), 행정심판위원회(행정심판), 법원(행정소송), 헌법재판소(헌법소원심판)의 현황을 살펴보고 문제점 및 개선방안을 도출하였다. 분석 결과, 국민의 권리구제 확대 방안으로 첫째, 지적측량 적부심사를 거친 경우에는 또 다른 권리구제 방법이 존재하지 않으므로 ｢공간정보관리법｣ 개정을 통한 지적행정, 지적위원회의 처분성 확대가 필요하다. 둘째, 권익위의 권고사항에 대해 행정기관에 강제성이 없으므로 의결에 대한 이행력 확보를 위한 제도 마련과 전담 공무원 충원이 필요하다. 셋째, 시도 행정심판위원회별로 처리결과가 다르므로 시도별 업무처리 방식과 처리결과의 공유가 필요하다. 넷째, 지적행정 관련 권리구제 제도들이 다루는 대상이 서로 다른데, 관련 정보가 충분히 제공되지 않아 국민과 담당 공무원들에게 혼란을 주고 있으므로 이를 국민에게 안내할 수 있는 제도를 마련하고 권리구제를 다루는 공무원들 간의 상호 협력 및 정보교류 시스템이 구축되어야 할 것이다.

영문 초록

This study examines the current status of the related rights remedies system, the Cadastral Committee(cadastral surveying suitability review), the Anti-Corruption and Civil Rights Commission(grievance complaints), the Administrative Adjudication Committee(administrative adjudication), the Court(administrative litigation), the Constitutional Court(constitutional complaint adjudication) for resolving the inconveniences related to cadastral administration of the people, and draws out problems and improvement plans. As a result of the analysis, it is necessary to expand the disposition of the cadastral administration and the cadastral committee through the revision of the ｢Spatial Data Management Act｣ because there is no other way to remedy the rights when the cadastral surveying suitability review has been passed. Second, there is no enforcement agency in the the Anti-Corruption and Civil Rights Commission's recommendations, so it is necessary to prepare a system to secure the ability to implement decisions and recruit dedicated civil servants. Third, since the results of processing are different for each provincial administrative adjudication committee, it is necessary to share the work processing methods and processing results by provinces and provinces. Fourth, the subjects of rights remedies related to cadastral administration are different from each other. However, due to insufficient information provided, it is causing confusion to the public and public officials in charge. A system that can guide this to the public and a system for mutual cooperation and information exchange between public officials dealing with rights remedies should be established.
