소년사법 중간처우의 활성화에 관한 연구

국문 초록

최근 10년간 전과가 있는 소년범의 비율은 증가와 감소를 반복되고 있다. 이는 코로나 19, 가족문제, 경제문제, 심리적 장애 등으로 학업ㆍ사회 적응에 어려움을 겪으며 건강한 성장 여건을 갖추지 못한 위기청소년이 증가하고 있기 때문이다. 위기청소년 증가에 따른 청소년 상담이 증가하고 있고, 전체 자살사망자 수는 감소하고 있는데도 불구하고 10대ㆍ20대 자살사망자 수는 증가하는 추세이다. 또한 최근 경찰청 자료에 따르면 지난해 법원 소년부로 송치된 촉법소년은 9,606명이다. 2016년 6,575명에 비해 약 46% 증가한 수치다. 최근 5년간 전체 촉법소년은 3만 9,694명으로 이 중 76%는 절도와 폭력 혐의다. 청소년들이 다시 범죄를 저지르는 상황도 나아지지 않는 모습이다. 보호의 이념을 바탕으로 하는 소년사법은 소년의 건전한 육성을 위한 처분을 통해 처벌보다는 문제해결을 도모하는 것이다. 소년범들에게는 개인적인 특질 외에 생활환경이나 사회환경의 변화에 지원이 요구되며, 교육, 의료, 복지 등 다방면적인 지원이 절실한 실정이다. 소년범에 대한 강력처분 및 구금시설의 효과성에 대해서는 의문과 역효과까지 제기되었고 비행청소년에게 경직된 시설내 처분보다는 지역사회에 기반을 둔 중간처우의 전환이 필요하다. 오늘날 소년사범들에게는 형사처벌보다는 교화개선을 강조한 다양한 보안처분이 강조되고 있으며, 이와 더불어 소년사법에 있어 중간처우는 반드시 필요하다. 따라서 이 논문에서는 교정처우의 하나인 소년사법에 대한 중간처우 제도에 대해 살펴보고자 한다.

영문 초록

Looking at the proportion of juvenile offenders with criminal records over the past 10 years, the increase or decrease is repeated. This suggests that the habitualization of juvenile crimes is at a serious level, and systematic correctional education and continuous follow-up management are needed for juvenile offenders with high recidivism rates in the future. The number of youth in crisis who have difficulty adapting to school and society due to family problems, economic problems, and psychological disorders such as COVID-19 is increasing, youth counseling is increasing, and the total number of suicide deaths is decreasing. According to the global trend, there are various regions for juvenile offenders in Korea. Social correction treatment is also being performed in Korea, but some systems often fail to function properly due to lack of facilities or manpower, and there are many cases where their efficiency is not achieved due to insufficient cooperation systems between related organizations. However, in order to revitalize community correction, close cooperation between juvenile centers and probation centers, which face juvenile offenders in the last stage or at the forefront of the juvenile justice system, is required. In the case of foreign countries, it is necessary to consider the complete integration of the two institutions in the future, considering that treatment in the facility and treatment outside the facility are not different in correction, and that distinguishing them is also meaningless. In this case, it is judged that it will be of great help in diversifying and internalizing protective measures for juvenile offenders. In addition, it is necessary to consider the active introduction of various community correction treatment systems adopted by developed countries. This is because if various intermediate treatment systems are introduced for juvenile offenders with the local community, active and positive correction can be implemented away from the current pattern of monotonous protection measures, and the effect of correction will be great.
