통합「경찰법」상 주민 중심 기초 단위 자치경찰제의 실질적 운영방안 모색

국문 초록

지난 2021년부터 전면 도입된 자치경찰제가 성공적으로 정착되고 지속 가능한 발전을 이루기 위해서는 경찰 권력의 민주적 지방분산을 통해 국가경찰과 자치경찰의 기능이 서로 조화를 이루는 가운데 자치경찰과 관련된 정책의 결정 및 집행 과정에 주민의 참여가 더욱 적극적으로 보장되어야 한다. 이 연구에서는 통합 「경찰법」상 현행 자치경찰제도가 적극적 주민참여를 통해 지방분권과 지방자치의 근본적 이념을 실현하는 제도로 거듭나기 위한 정책적 대안으로 시․군․구 기초 자치단체 단위의 주민 중심 자치경찰제의 실질적 확대방안을 모색하였다. 연구결과, 기초 단위 자치경찰제의 실질적 운영을 위해서는 첫째, 사무 범위에 관한 조례 제정 시 시․군․구청장의 의견수렴 장치 마련, 시․도자치경찰위원회와 기초자치단체장 간의 상설 협의체 운영, 시․도자치경찰위원회 위원장 등 자치경찰 인사에 대한 시․군․구청장의 참여, 지역치안협의회의 활성화, 지구대장 및 파출소장 임명에 관한 주민추천제 확산 등 기초자치단체의 권한 확대를 위한 법․제도적 개선이 이루어져야 할 것이다. 둘째, 기초 자치단체 단위의 지역별 특화모델 개발이 필요하다. 기초 자치단체 단위의 지역별 특화모델은 크게 도시 중심형 특화모델, 도농 복합형 특화모델, 농․어촌 중심형 특화모델 등 세 가지의 모델로 설정할 수 있으며, 이를 통해 주민 중심의 새로운 치안 패러다임을 실현하여 지역주민 밀착형 치안서비스를 제공해야 할 것이다. 셋째, 나아가 읍․면․동 기초 단위의 참여 확대로 이어져야 할 것이다. 이를 위해서는 주민자치회 확대를 통한 주민 참여형 치안정책 수립, 읍․면․동장으로의 행정권한 위임 확대를 통해 지역맞춤형 치안활동이 실시될 수 있도록 해야 할 것이다.

영문 초록

For successful settlement and sustainable development of Municipal Police system that has been introduced from 2021, participation of local residents in the process of decision and execution of polices related to Municipal Police must be guaranteed more actively while the function of national police and Municipal Police accomplish harmony through democratic decentralization of police authority. Therefore, this study searched for a practical plan for expansion of primary Municipal Police system of cities and countries as a political alternative for existing Municipal Police system in the integrated「Police Act」 to become a system capable of realizing the basic principle of decentralization and local government through active participation of local residents. For practical operation of primary Municipal Police system, results show that First, legal and institutional improvement such as preparation of a device for collection opinions from the head of cities, counties and districts, operation of a permanent consultative body between Municipal Police committee and local government directors, participation of the head of cities, counties and districts in personnel matters of Municipal Police, revitalization of local security council and introduction of resident recommendation system for appointment of police district captain and chief of police substation when enacting an ordinance on the scope of administrative works. Second, development of a specialized model for primary local governments is considered necessary. Specialized models for local governments can be set up largely as three types such as urban-centered model, urban and rural complex model and rural-centered model, and through the aforementioned, local residents-oriented police service must be provided through realization of a new police paradigm focusing on the local residents. Third, participation of local government of Eup, Myeon and Dong must be expanded. For the foregoing, it is necessary to enable localized police activities to be carried out through establishment of resident-participating police policy through expansion of residents’ association and expansion of delegation of administrative authority to the heads of Eup, Myeon and Dong.
