항만보안 관할권 소재에 관한 법적 고찰

국문 초록

최근 3년간 우리항만에 정박 중이던 국제항해선박에서 무단이탈한 외국인선원은 23명으로 파악되고 있다. 그러나 국가중요시설인 항만 보호구역내 무단이탈의 예방과 대응 등 해상보안 업무와 관련하여, 정부 부처 간 관할권이 불명확함에 따라, 무단이탈이 발생하여도 책임소재조차 제대로 규명되지 않고 있는 실정이다. 이 연구는 관할 책임소재가 가려지지 않고서는 ‘항만보안의 사각지대’에서 파생되는 다양한 국가안보상의 문제들이 발생할 수 있다는 점에서, 항만 보호구역 중 해상구역에 대한 보안관할권(관할책임)을 어느 국가기관이 가지는가에 관하여 법률적으로 검토하고 입법적 개선책을 제시하기 위한 목적에서 수행되었다. 연구방법과 관련해서는 이 분야에 대한 선행연구를 찾기 어려웠고, 해양수산부와 해양경찰청 등 항만보안 유관기관에서도 공식적인 견해를 밝히지 않음에 따라, 전문가 인터뷰, 언론보도, 국내외 문헌 등을 바탕으로 연구를 수행하고 법률적인 문제점과 개선책을 도출하였다. 연구 결과, 항만의 특수성에 부합하도록 육상구역과 해상구역을 불문하고 어느 하나의 기관으로 보안관할권을 일원화하는 것이 예방과 대응을 연계적으로 수행할 수 있다는 점에서 보다 효과적이라는 결론에 도달하였다. 즉, 외국인 선원에 대한 감독권한을 가지며, 항만의 관리ㆍ운영 및 항만보안 업무의 주무부처인 해양수산부가 해상구역에 대한 관할권을 행사하는 것이 합리성과 타당성을 가진다.

영문 초록

A port has a meaning as a border in that foreign arrivals are made through the arrival and berthing of international ships, and it can be said to be a very important element for national security such as the prevention of maritime terrorism. However, over the past three years, 23 cases of foreign sailors leaving the sea from international ships that were anchored in our port have been identified. In particular, in the case of Gamcheon Port in Busan, there were 12 foreign crew members evacuating without permission during 2020, revealing loopholes in our port security system. A more fundamental problem is that even if a foreigner evacuates without permission, the jurisdiction of maritime security within the port protection area is not clear, so even the clear location of responsibility for jurisdiction between the relevant agencies is not identified. In this study, if the location of jurisdiction for the maritime area of ​​a port is not fundamentally resolved, fatal consequences for national security derived from the blind spot of port security are likely to occur at any time. review and suggest improvement measures. Regarding the research method, as there has been no prior research in this field in the academic world, and the port security-related organizations do not disclose their official views, the position of the institution is indirectly understood and researched based on expert interviews, media reports, and domestic and foreign literature. was performed. Port security-related institutions were centered on the Ministry of Oceans and Fisheries, which is the department in charge of port security under the International Ship Port Security Act, and the Port Security Corporation, and the Korea Coast Guard, the department in charge of maritime security under the Maritime Security Act.
