스토킹처벌법상 온라인 스토킹 행위의 유형과 적용범위에 관한 연구

국문 초록

이 연구는 현행「스토킹처벌법」제정 이전, 온라인 스토킹 행위에 대하여 「정보통신망법」상 유죄가 확정된 판결을 중심으로 온라인 스토킹의 유죄 인정의 쟁점과 그 유형들을 확인하였다. 이를 통해, 현행법상 온라인 스토킹의 유형과 적용범위의 한계를 파악하고, 추후 개정 시 참고할만한 근거를 제안하였다. 자료수집을 위해 2013년 이후, 「정보통신망법」제44조의7 제1항 제3호로 1심 판결문을 중심으로 총 138건을 검토하였고, 이 중 주요 판례 24건에 대하여 쟁점과 한계를 논의하였다. 검토 결과, 현행법상 ‘도달하게 하는 행위’에 대하여 우리 판례는 온라인상 게시물, 영상 등의 유통 등도 실효적으로 폭넓게 인정한 것을 확인하였다. 또한, 온라인 스토킹이 다양한 유형으로 광범위한 대상에게 이루어지고 있어, 피해자 보호의 한계를 발견하였다. 이에 따라, 개인정보를 수집·이용·게시·배포하는 행위 등을 이용한 온라인 스토킹을 규제행위에 추가할 것을 제안하였다. 나아가, 미국·독일 등 온라인 스토킹 상대방을 제3자로 규정한 것을 참고하여, 그 범위를 합리적으로 개정할 필요성도 강조하였다

영문 초록

This study has been conducted to suggest the direction of revision of online stalking regulations under the 「Act on Punishment of Stalking」. It was intended to find various stalking cases and the court’s judgment on them through the precedents analysis of the 「Act on Promotion of Information and Communications Network Use and Information Protection, etc」. The Korean court case site called ‘the judgment reading system’ was used for analysis purposes. Based on 「Act on Promotion of Information and Communications Network Use and Information Protection, etc」of the 138 first instance judgements convicted, finally, 24 clear precedents were used by excluding those that did not satisfy the purpose of the study. Although, the research identified that the expansion of the meaning of an “act of reaching” includes the act of posting articles on the Internet, at the same time, there are still ambiguous and unclear part of the laws that should be interpreted. Furthermore, there was a gap between the actual online stalking cases and the range of stipulated punishment. As a result, this study suggests further discussions, which include clearer criteria for interpreting the law, and definitions of determining the types of online staking behavior and the range of victims.
