국문 초록

1990년 초에 들어서면서 중국의 개혁개방은 새로운 발전단계에 진입하게 되었는바 부동산업도 신흥산업 의 자태로 폭발적인 발전을 하게 되었으며 중국의 경제 및 사회발전에 큰 기여를 하였다. 그러나 중국의 부동산업은 그 시작이 늦었을 뿐만 아니라 오히려 급속한 경제성장단계의 영향을 받아 중국 부동산 시장도 그 급속한 성장과 함께 과열양상을 보이게 되었으며 여러 가지 문제점들을 노출시켰다. 특히, 외국인투자자들이 중국 부동산시장에 대해 전략적으로 투자함에 따라 해외단기자금이 중국 부동산시장에 대량 유입되었는바 이는 한편으로는 중국 부동산시장을 활성화시켰으나 다른 한편으로는 토지와 집값 상승을 초래하는 계기가 되었다. 이러한 상황은 중국부동산시장의 정상적인 질서와 건강한 발전에 부정적인 영향을 미쳤다고 볼 수 있다. 최근 연간 중국정부는 일련의 거시적인 경제통제수단을 동원해 토지와 집값을 엄격히 통제하였으나 부동산시장에서의 과열양상은 수그러들지 않았고 외국인투자자들의 중국 부동산시장에 대한 기대와 매력도 식을 기미를 보이지 않았다. 올해 들어 일부 변화들이 감지되고는 있으나 일시적인 현상이라고 판단된다. 이러한 상황을 감안하여 중국 부동산시장에 대한 외국인투자현황을 요해하고 이를 바탕으로 외국인 부동산투자와 관련된 법제에 대해 연구해 볼 필요가 있다. 따라서 본 논문은 중국 부동산시장에 대한 외국인투자현황에 근거하여 투자주체, 투자행위, 투자대상으로 나누어 외국인 부동산투자와 관련된 법제를 분석해 보기로 한다. 중국부동산시장에 대한 외국인투자를 규범화하기 위해서는 외국인 부동산투자와 관련된 법률 및 행정법규들을 부단히 정비하고, 중국 부동산업종에 투자한 외자기업들의 경영과 서비스에 대한 관리감독을 강화하며, 지방정부의 권한을 대폭 제한하고, 부동산업종과 타 분야와의 정책연대를 강화해야 한다.

영문 초록

Since the early 1990s, China s reform and opening up has entered a new stage of development. China s realty business is also rapidly developing as an emerging industry , making great contributions to China s economic and social development. However, due to a late start and catching up with a rapid economic development period, China s real estate market is becoming overheating and has exposed a series of problems. The foreign strategic investment and some overseas short-term speculative funds into the real estate market of China have stimulated the further development of China s real estate market and at the same time directly led to the rise of land and housing prices in China, which, to a large extent, has affected the normal order and healthy development of China s real estate market. Although the central government adopted a series of macro control policies to strictly control the land prices and housing prices in recent years, the situation of the real estate market is still overheating and is unpromising. At the same time, the expectations and charms of the foreign investment in the real estate market are still unabated. Given the above situation, we need to understand the status quo of the foreign investment in China s real estate market and analyze the laws and regulations related to the foreign investment in the real estate based on the status quo. This paper will emphatically analyzes the laws and regulations on the foreign investment in China s real estate market in the light of its status quo and divides the foreign investment into the investment subject, the investment and investment object. In order to further regulate the activities of foreign access to China s real estate market, a number of measures should be taken in consideration of law: for example to further improve laws and regulations on foreign investment in real estate, to strictly regulate the business and services of the foreign-funded enterprises in the field of real estate, to strictly limit the authority of local governments, and to strengthen the linkage with the policies of other areas.
