부동산거래사고 예방을 위한 입법적 개선방안 연구

국문 초록

2008년에서 2015년까지 개업공인중개사 또는 중개보조원의 부주의나 고의적인 문제로 1,424건의 사고가 발생하였으며, 매년 평균 178건의 사고가 발생하고 있다. 이러한 사고가 빈번히 발생하고 있음에도 거래사고를 사전에 예방할 수 있는 제도적 장치는 미흡한 실정이다. 이에 본 연구는 개업공인중개사의 중개대상물 확인·설명과 중개보조원에 관한 부동산거래사고를 중심으로 판례를 분석하여 문제점을 도출하고, 이에 대한 입법적 개선방안을 찾고자 하였다. 특히 2010∼2015년(5년간) 개업공인중개사를 상대로 소송한 하급심에서 대법원까지 판결되어진 사건을 유형별로 분류하였으며, 한국공인중개사협회 공제에 가입하고 소송이 제기된 개업공인중개사의 거래사고를 중심으로 판례를 분석하여 객관성을 확보하고자 하였다. 연구결과 첫째, 개업공인중개사에게 부동산 임차현황을 열람할 수 있도록 권한을 제도적으로 부여. 둘째, 「공인중개사법」 시행규칙에서 규정하고 있는 중개대상물확인․설명서를 개선. 셋째, 무자격 및 무등록자에 대한 지도·단속을 강화. 넷째, 부동산계약에 따른 권리보험을 제도화. 다섯째, 중개보조원의 중개행위를 막기 위해 1회의 중개행위도 처벌할 수 있도록 「공인중개사법」개정 방안을 도출하였다.

영문 초록

There have been 1,424 real estate transaction incidents since 2008 to 2015 with the average of 178 each year inflicted by intention or negligence of licensed real estate agents or brokerage assistants. Although they are occurring frequently, there is insufficient institutional system to prevent transaction incidents in advance. This study is to define problems by analyzing judicial precedents on real estate transaction incidents related to confirmation and explanation of brokerage object and brokerage assistants and to find improvement measures through legislation. In particular, the cases that were judged in the lower court to the Supreme Court against licensed real estate agents in 2010-2015 (for 5 years) were classified by type. Moreover, I tried to secure objectivity by analyzing precedents on transaction incidents of real estate agents who participated in mutual aid projects of Korea Association of Realtors(KAR). As a result of the study, the following conclusions were drawn as a direction of amendment to the law : Institutional empowerment of licensed real estate agents to view real estate lease status, improvement of confirmation and explanatory note of the object of brokerage, strengthening restriction of illegal brokerage, institutionalizing rights insurance under real estate contracts, and punishment of a single mediation by brokerage assistants.
