미국 교육재정정책 관련 주요 판례의 의미와 영향력 분석

국문 초록

미국에서는 교육정책형성과정에서 사법부의 적극적 개입이 일어나고 있다. 교육재정정책 분야에서도 연방 및 주 대법원의 판결은 교육의 기회균등 및 공정성 제고를 위한 정책개선을 이끌어왔다. 연방 수정헌법 제14조의 평등보호 조항은 세라노 판결에서 빈곤한 학교구의 학생들의 1인당 교육비 불평등 문제를 개선하는 근거조항으로 활용되었다. 하지만 로드리게즈 판결에서는 연방헌법 상 교육의 기본권성이 부정되었는데 이에 따라 이후 교육재정정책 관련 소송에서는 교육재정의 불평등성을 주장하는 원고측은 주 헌법의 교육관련 직접조항을 근거로 주 정부의 교육재정정책의 위헌성을 주장하게 되었다. 이러한 소송에서 쟁점은 교육개정정책이 주 정부의 교육적 목적 실현에 어느정도 기여하고 있는지 여부였다. 점차적으로 교육재정정책 관련 소송에서는 공정성보다는 적정성 기준이 소송의 핵심 이슈가 되었다. 이는 교육제도가 학생들을 위한 기초적인 교육기회를 제공하는 것을 넘어서 철저하고 효율적인 교육을 실현해야 한다는 주의 교육책무성을 근거로 교육재정의 불평등성을 다툴 수 있도록 하였다. 이러한 소송의 결과 주 정부는 교육재정정책 개선을 위한 법률 제･개정 및 분배제도 개선 등의 후속활동을 진행하였다.

영문 초록

In the United States, active intervention by the judiciary is taking place in the process of forming educational policies. In the field of education and fiscal policy, federal and state Supreme Court rulings have led to policy improvements to improve equal opportunities and fairness in education. The equal protection provisions of Article 14 of the Federal Amendment were used in the Serano ruling as a basis for improving the problem of inequality in per capita education expenses for students in poor school districts. However, Rodriguez s ruling denied the basic rights of education under the federal constitution, and in subsequent lawsuits related to education finance, the plaintiffs, who argued for inequality in education finance, argued for the state s education finance policy. The issue in these lawsuits was to what extent the education revision policy contributed to the realization of the state s educational purpose. Gradually, in lawsuits related to education and fiscal policy, adequacy standards rather than fairness have become a key issue in litigation. This allowed the education system to dispute inequality in education finances based on the state s educational responsibility to realize thorough and efficient education beyond providing basic educational opportunities for students. As a result of these lawsuits, the state government carried out follow-up activities such as legislation, revision, and distribution system improvement to improve education and fiscal policy.
