교육마이데이터 정보이동권 도입에 관한 법적 고찰

국문 초록

지능정보사회에는 인공지능, 빅데이터, 학습분석 등 지능정보기술이 발전함에 따라 데이터를 통해 다양한 부가가치를 창출하기 때문에 그 어느 때보다 데이터의 중요성이 증대되고 있다. 이에 2018년부터 정부는 4차산업혁명위원회를 출범시키고 국민의 데이터 주권 찾기를 위한 신용정보, 의료정보, 행정정보 등의 마이데이터 정보이동권을 법제화하였다. 또한 교육부는 2021년 11월 18일 교육 분야에도 정보이동권을 도입하겠다는 정책을 발표한 바 있다. 정보이동권의 도입은 한편으로는 교육데이터의 이용 및 활용을 활성화할 수 있고, 다른 한편으로는 정보 주체인 학생과 학부모의 개인정보 자기결정권을 적극적으로 보장할 수 있다는 장점이 있다. 그러나 교육마이데이터는 정보주체에게 매우 민감한 정보로 오남용이나 유･노출의 경우 정보 주체의 사생활과 인격권을 심각하게 침해할 소지가 크다. 따라서 교육 분야 마이데이터의 정보이동권을 도입하기 위해서는 예견되는 법적 문제들을 살펴보고 어떻게 대응해 나갈 것인지에 대한 고민이 필요하다. 이 글은 교육마이데이터의 용어 정의를 시작으로, 정보이동권에 관한 현행 법령의 내용들을 검토하였다. 이를 통해 교육마이데이터 정보이동권을 법제화하거나 도입할 경우 예상되는 문제점이나 고려사항으로 법령체계, 대상 정보 범위, 제공의무자와 제공대상자로서의 제3자의 범위 등을 기준으로 살펴보고 개선방안을 제안하였다. 아직은 ‘교육데이터’나 ‘교육마이데이터’라는 용어조차 생소하지만 이글을 시작으로 교육마이데이터에 대한 연구와 관심이 증대되고, 정보이동권 도입에 따라 예측되는 법적 쟁점들을 해결하여 정보주체의 권리 보장과 교육데이터 이용 활성화를 기대해 본다.

영문 초록

In the intelligent information society, the importance of data is increasing as it creates various added values ​​through data with the development of intelligent information technologies. Accordingly, the government makes efforts to introduce My Data service and the right to data portability from 2018. In addition, the Ministry of Education recently announced that it would introduce the MyData service in 2021. On the one hand, the introduction of the right to data portability has the advantage of activating the use and utilization of educational data, on the other hand, it can actively guarantee the right to self-determination of personal information of students and parents. However, Education My Data is very sensitive information to the subject, and in the case of misuse or leakage, there is a high possibility that the privacy and personal rights will be seriously violated. Therefore, it is necessary to look at the legal issues that should be considered in order to guarantee the right to data portability of Education MyData and think about how to improve it. This article reviews the contents of the current laws and regulations on the right to data portability, starting with the definition of the term “Education MyData”. And, This article examine the legal system, the scope of the target Data, and the scope of the third party as the person obligated to provide as expected problems or considerations when legislating or introducing the right to data portability of Education My Data. Even the terms of education data and education Mydata are somewhat unfamiliar, Starting with this article, I look forward to be resolved the legal issues predicted by the introduction of information portability and guarantee the rights of data portability and vitalize the use of educational data.
