농어촌교육 법제의 주요 내용과 입법체계상 특징 및 입법 대안 검토

국문 초록

이 논문에서는 농어촌교육 법제를 종합적으로 분석하고, 그 결과를 토대로 농어촌교육 법제의 주요 내용과 입법체계상 특징을 도출하며, 향후 입법체계 개선을 위한 입법 대안을 검토 및 제시하는 것을 연구의 목적으로 하였다. 농어촌교육 법제의 입법체계상 특징은 다음과 같다. 첫째, 다양한 법률이 분담하여 규율하고 있으나, 체계적으로 분담하고 있다고 보기도 어렵다. 둘째, 기본적으로 지원법･진흥법의 성격이 강하나, 농어촌학교 재구조화 등 일부는 규제적 성격이 상당하다. 셋째, 전반적으로 특별법적 성격이 강하다. 넷째, 해당 사무의 소관 기관이 일반행정기관인지 교육행정기관인지 모호하고 국가와 지자체 간의 소관도 모호한 경우가 많다. 입법 대안으로는 농어촌교육에 대한 통합법을 특별법으로 제정하여 체계적으로 규율하는 방안을 1안으로 제안하였다. 또 2안으로 개별법이 규율하고 있는 사항 중 미흡한 점이나 개선할 점을 개정하고, 이를 통해 역할 분담을 체계화하는 방안도 제시하였다.

영문 초록

There exist more than eight laws which are related to rural education that are under the jurisdiction of the Ministry of Education, including the Framework Act on Education. Also, there are also more than four rural education realted laws falling under the jurisdiction of other government bodies. As such, legal provisions for rural education are regulated by means of a number of different laws, and their characteristics and issues are as follows. First, while various laws contain different provisions pertaining to rural education, the roles of each law are not systematically distributed. Second, laws addressing rural education generally support or promote rural education, but some of the provisions such as the restructuring of rural schools are considerably regulatory. Third, most laws on rural education have the characteristics of special law. Fourth, it is often ambiguous as to whether the agency responsible for the relevant affairs is either a general administrative agency or an educational administrative agency, and the jurisdiction between the state and local governments stands as also ambiguous in many cases. In this study, we propose the following legislative measures in order to address the issues identified above: an enactment of an integrated special law on rural education for a systematic organization of provisions on rural education and revision of individual laws which are in need of improvement to systematize the division of roles within each law.
