국문 초록

헌법재판소가 판단하였듯이 자유민주주의 사회를 지향하는 헌법 체제에서 사학은 그 바탕이 되는 교육의 다양성을 제고하는 역할을 하여야 한다. 필자는 본 논문에서 21대 국회에서 개정된 사학법의 내용을 검토하고 이것이 사학의 이러한 역할에 긍정적으로 기여할 것인지를 검토하였다. 이를 위하여 필자는 개정 사학법의 내용 등 세 가지를 검토하였다. 검토 결과는 이러하다. 개정 사학법은 사학의 자주성에 전혀 기여하지 않는다. 일부 사학의 비리에 맞서는 방법으로 전체 사학에 대해 지금처럼 대증요법으로 규제를 계속 강화해서는 아니 된다. 사학법을 전혀 다른 관점에서 전면 개정하여야 한다. 사학을 사학답게 하여 학교교육 전체가 다양성을 확보할 수 있도록 해야 한다. 사학의 공공성 확보와 자주성을 동시에 도모하도록 사학법인과 사학평가제를 도입하여야 한다. 평가결과에 따라서 우수사학에 대해서는 규제를 파격적으로 완화해 주어야 한다. 부실과 비리의 문제 사학에 대해서는 더욱 엄중하게 책임을 물어야 한다. 사학의 공영화가 아니라 우수사학이 그 특수성과 자주성을 잘 구현해가도록 더욱 지원하고 조성하여야 한다. 정부 재정을 명문 사학을 일반학교로 바꾸는 데 투입하기보다 그 재정을 공립학교에 집중 투자하여야 한다. 우수사학의 장점을 활용하여 공립학교의 교육의 질을 사학 못지않게 높여야 한다. 이를 통하여 전체적으로 학교교육의 수준을 상향평준화하여야 한다.

영문 초록

In the constitutional system that aims for a liberal and democratic society, private schools should play a role in enhancing the diversity of education that is the basis. In this paper, I reviewed the contents of the Private School Act revised by the 21st National Assembly and examined whether it would positively contribute to this role of private schools. To this end, I reviewed three things, including the contents of the revised private school law. The review results are as follows. The revised private school law is not conducive to the independence of private schools at all. As a way to combat the corruption of some private schools, we should not continue to strengthen regulations on all private schools as kinds of symptomatic treatment. The private school law needs to be completely revised from a completely different point of view. By making private schools a private school, the whole school education should be able to secure diversity again. A private school evaluation system should be introduced to secure publicity and promote independence of private schools at the same time. According to the evaluation result, regulations on excellent private schools should be radically relaxed. Regarding the problem of insolvency and corruption in private schools, responsibilities should be taken more seriously. It is not intended to publicize private schools, but to support and foster excellent private schools. Government finances should not be used to convert prestigious private schools into general schools. The funds should be focused on public schools. The quality of education in public schools should be as high as that of private schools by utilizing the advantages of excellent private schools. Through this, the level of school education as a whole should be equalized.
