독도의 지위 관련 연구 동향

국문 초록

외국 연구자들이 미국에서 발간되는 학술지에 발표하는 독도관련 연구는 일반적으로 생각하는 것처럼 깊이가 있거나 이론이 정연하지는 않는 것 같다. 이들의 연구는 독도의 영유권 다툼을 다루거나 국제해양법상 일반적인 섬의 지위를 다루면서 독도를 연구하고 있다. 즉, 독도가 해양법상 어떠한 해양관할수역을 갖는지, 혹은 해양경계획정에서 어떠한 효과를 갖는지가 연구의 대상이다. 독도 영유권과 관련하여서는 한국의 주장을 지지하는 학자와 일본의 주장을 지지하는 학자로 나누어지는데, 이들은 대체로 한국과 일본의 정부 입장이나 학자들의 연구를 바탕으로 논거를 마련하고 있다. 그리고 로스쿨 학생들과 같은 연구자들은 심도있는 분석을 하지 않고 선행 연구자들의 주장을 그대로 답습하는 모습을 보이고 있다. 이들이 대체로 한국에 유리한 주장을 하고 있는 것은 나름대로 위안거리라고 하겠다. 한편 독도의 해양법상 지위는 제한적인 것으로 판단하고 있는데, 대체로 배타적 경제수역이나 대륙붕을 갖지 못하는 바위섬으로 취급하고 있으며 또한 일본과의 해양경계획정에서 아무런 효과도 갖지 못할 것으로 전망하고 있다. 한편 외국 연구자들은 독도 영유권 문제를 연구함에 있어 대체로 영어로 된 인터넷 자료를 많이 인용하며 연구하고 있는데, 특이한 점은 일본 주장을 지지하는 연구자는 일본 정부의 주장을 인용하고 있음에 반하여 한국의 입장을 지지하는 연구자는 개인이 운영하는 인터넷 사이트를 인용하고 있다는 것이다. 그리하여 우리의 주장을 영문으로 소개하는 사이트의 적극적인 활용이 요구되고, 또한 한글로 발표된 독도 관련 연구결과물을 외국어로 소개하는 작업도 활발하게 진행할 필요가 있다고 본다.

영문 초록

Studies of the legal status of Dokdo published by foreign scholars are not deep and well-organized in theory as generally expected. They have examined the dispute over the sovereignty of Dokdo or the legal status of Dokdo in the law of the sea. In other words, they deal with maritime jurisdiction of Dok do and the effect of Dokdo in the maritime delimitation. Concerning the sovereignty of Dokdo, some scholars are to support the Korea s claim to Dokdo, the others support the Japanese position. Their arguments are based on the official positions of these States, Korea and Japan, and the research of their scholars. And some researchers like law students are not doing any in-depth analysis and just tend to follow the arguments of leading researchers. Fortunately they are generally making arguments in favor of Korea in sovereignty dispute. In the meantime, they have argued that legal status of Dokdo in the law of the sea are so restricted that Dokdo generally seems not to be entitled to the exclusive economic zone of the continental shelf and not to have any effect in the maritime delimitation of the East Sea between Korea and Japan. Foreign researchers are doing research with materials from the web site in English. Scholars to support the Japanese position are tend to cite Japanese government s arguments but those scholars in favor of Korean position have used the documents in the web site operated private researchers. Therefore it is highly recommended to develop web site concerning Dokdo in English for the Korea s position about Dokdo to be widely known to the world. And it is also required to publish articles dealing with the legal status of Dokdo including its sovereignty in foreign language including English.
