문화재로서 폐사지의 가치 인식과 보존․활용에 관한 제도적 기반 마련

국문 초록

일찍이 불교문화가 융성한 까닭에 우리나라에는 폐사지들이 많다. 그런데 그중에서 문화재로 지정 또는 등록된 것은 약 1.84%가 전부다. 나머지는 법적 보호 대상이 되지 못하고 있다. 폐사지들은 빈터가 아니라, 역사적․문화적 가치를 갖는 것들이다. 탑과 탑비, 불상, 당간지주 등 문화재들이 있기도 하고, 매장문화재가 분포할 가능성도 높다. 그런데 보호 장치를 갖추지 못해서 가치를 잃어가는 일이 많다. 소재 문화재들도 도난 또는 훼손되는 일이 흔히 있다. 문화재로서 폐사지를 보존하는 데는 우선 그것들을 문화재로 인식하는 것이 중요하다. 세 가지 방안을 생각할 수 있는데, 그동안 조사해온 결과를 바탕으로 폐사지들의 가치를 재평가하여 가능한 한 문화재로 지정하는 것이 첫 번째다. 이 연구에서 주목하는 것은 아직 문화재로 지정할 만큼 그 가치가 크지 않은 폐사지들이다. 여기에는 등록문화재 제도를 활용할 수 있다. 새로 도입된 시․도등록문화재 제도를 검토해볼 만하다. 세 번째는 폐사지에 문화재로서의 의미를 부여하는 새로운 제도를 도입하는 것이다. 이는 폐사지를 문화재로 보호하면서도 대부분이 사유재산임을 고려하여 규제를 최소화하는 방안이라고 할 수 있다. 이처럼 제도적 기반을 마련하는 것은 폐사지를 문화재로 보존하고 활용하는 데 필수적이다. 문화재 보존․활용 지평을 넓힌다는 점에서도 의미가 큰 방안이 될 것이다.

영문 초록

There are numerous temple sites in Korea because Buddhist culture flourished early. However, about 1.84% of the temple sites are designated or registered as cultural heritages. The rest of the temple sites have not been designated or registered as cultural heritages and have not been legally protected. However, the temple sites are not just empty sites, but historically and culturally valuable cultural properties. In the temple sites, there are also cultural properties such as pagodas, tombstones, Buddhist statues, and Dangganjiju(flagpole support of a temple), and there is a high possibility that cultural properties are buried. Even though it is such a valuable cultural heritage, there are many things that lose its value due to lack of protection. Cultural properties located in the temple sites continue to be stolen or damaged. In order to preserve the meaning and value of temple sites as cultural properties, it is important to recognize them as cultural heritages first. I think of three specific ways. The first is to reevaluate the value of the temple sites based on the results of the investigation and designate those with sufficient value as cultural heritages as possible. At the same time, what this study pays attention to is the temple sites that are not yet valuable enough to be designated as cultural heritages. The registered cultural heritage system can be utilized here. The newly introduced registered cultural heritage system by the metropolitan city or province deserves to be considered. The last option is to introduce a new legal system that gives meaning to the temple site as a cultural property. This is a way to minimize regulations considering that most of the temple sites are private property while protecting the temple sites as cultural heritages. As such, establishing an institutional foundation for the temple site is essential to protecting and utilizing it as a cultural heritage. Furthermore, it will be a significant measure in that it expands the horizon for preserving and utilizing cultural heritages.
