코로나19 이후 사이버 학교폭력 대응 법제의 쟁점 및 개선방안 연구

국문 초록

코로나19 이후 등교수업이 축소되어 원격수업과 등교수업이 병행 실시되었으며, 이 기간 동안에 사이버 학교폭력은 크게 증가한 것으로 나타났다. 그러나 현행 ｢학교폭력예방 및 대책에 관한 법률｣이 규정한 학교폭력 등의 정의만으로는 사이버 학교폭력에 대해 효과적으로 대처하기 어렵다는 주장이 제기되었다. 이에 이 연구는 사이버 학교폭력 관련 법령을 살펴보고, 코로나19 이후 정부가 실시한 사이버 학교폭력 실태조사 결과를 점검하며, 주요 쟁점 및 문제점을 분석하고 개선방안을 도출 및 제시하였다. 주요 쟁점으로는 사이버 학교폭력의 정의 및 유형의 모호성, 사이버 학교폭력 증가 및 초등학생 피해 증가, 사이버 학교폭력에 대한 초기 대응 및 사안처리 지원 미흡 등이 도출되었다. 이러한 문제를 해결하기 위한 개선방안으로는 사이버 학교폭력의 정의 추가 및 실태조사에도 포함, 사이버 학교폭력의 특성을 고려한 국가 수준의 전문적 대응체계 구축, 학교･교육청의 사이버 학교폭력 초기 대응 및 사안처리 지원 방안 마련, 가정-학교 연계 대응을 위한 사이버 학교폭력 학부모 교육 강화 등을 제안하였다.

영문 초록

In Korean K-12 schools, contactless classes have increased due to COVID-19. In the meantime, the number of instances when students have fallen victim to “online violence” has increased sharply. However, it is difficult to effectively tackle school-related online violence by using only the definitions of “school violence” and “cyber-bullying” provided in the Act on the Prevention of and Countermeasures Against Violence in Schools. Hence, this study aims to examine existing laws regarding school-related online violence, analyze national surveys on school-related online violence, and identify the main issues and critical problems. The main issues are as follows: (A) The definition of the term “school-related online violence” and its categories are vague; (B) School-related online violence has increased, especially considering the number of victim students has been increasing in elementary schools; and (C) The initial response and guidance on how to deal with school-related online violence has been insufficient. To resolve these issues, it is necessary to change existing regulations and policies as described below. First, the Act should be amended by adding an updated definition for the term “school-related online violence.” Second, the government should establish and operate a national specialized institution for school-related online violence. Third, the government should support local education and K-12 school offices in their initial responses to school-related online violence, and provide comprehensive guidelines on how to deal with such violence. Last, educational programs should be provided to students’ parents for the prevention of and countermeasures against school-related online violence.
