코로나19 이후 대안교육기관 이용 학생의 안전 및 학습권 보장에 관한 쟁점 및 개선 과제 연구

국문 초록

지난 2021년 1월 12일에 ｢대안교육기관에 관한 법률｣(이하 “대안교육기관법”이라 함)이 제정되었다. 그런데 법률 제정 이후인 2021년 1월 23일에 일부 종교단체가 운영하는 미등록 대안교육시설에서 이용 학생 등 420여 명이 코로나19에 집단감염되는 사건이 발생하였다. 이를 계기로 미등록 교육시설의 학생 실태 파악과 안전에 대한 우려가 크게 제기되었다. 이에 코로나19 관련 미인가 교육시설 실태 및 행정 조치 실태를 조사･분석하고, 교육부의 미인가 대안교육시설 현황 조사 결과를 분석하며, 코로나19 이후 대안교육기관 이용 학생의 안전과 학습권 보장에 관한 쟁점을 분석하여 법적･정책적 개선과제를 도출하였다. 주요 쟁점으로는 미등록 시설 실태조사 및 현황 파악의 어려움, 학생 안전 대책 미흡, 학교 형태 운영 및 명칭 사용 위반 시 벌칙 부과 미흡, 등록 기관에 대한 예산 지원 부족 등이 도출되었다. 이러한 문제를 해소하기 위해서는 범부처 대안교육 정보공유체계 구축, 대안교육기관 등록 유도 및 법 위반 시 후속 조치 가이드라인 마련, 등록 기관에 대한 시･도의 자율적인 예산 지원 확대, 의무교육대상 이용 ‘미등록 교육시설 신고제’ 도입 등의 입법 및 정책 개선이 필요하다는 점을 결론으로 제시하였다.

영문 초록

On January 12, 2021, the “Act on Alternative Education Institutions” was enacted. However, after the enactment of the law, on January 23, 2021, a massive coronavirus outbreak was reported at an unauthorized alternative education institution run by a religious group. Approximately 420 people, including students, linked to the institution were found to be infected with COVID-19. This raised concerns over the student safety and the lack of information on students enrolled in unauthorized alternative education institutions. Hence, this study analyzes the results of the survey on unauthorized alternative education institutions, reviews the current issues related to students’ right to learn and the safety of students at alternative education institutions after COVID-19, and suggests the legislative and policy measures for improvement. This study presents the following issues related to alternative education institutions: the challenges of surveying and examining the current status of unauthorized institutions, the lack of student safety measures, insufficient penalties for the violation of current law, and deficient financial support for registered institutions. As a result, we propose the following legislative and policy measures to address the issues identified above. First, an inter-ministerial system for sharing information on alternative education institutions needs to be established. Second, plans to encourage registration and guidelines on follow-up measures in case of violation of the law need to be prepared, Third, financial support from local authorities to registered institutions needs to be expanded. Fourth, it is necessary to establish a minimum requirement for unregistered institutions educating children of compulsory school age to file a notification or report.
