국문 초록

주지하는 바와 같이 현행의 교육법 체계는 1995년 5월 31일 대통령자문교육개혁위원회의 “세계화 정보화 시대를 주도하는 신교육체제 수립을 위한 교육개혁방안” 제창 이후, 이 위원회의 권고에 따른 여러 가지 교육 개혁 입법 조치가 단행된 결과로서, 1997년 12월 13일 구 교육법을 교육기본법, 초･중등교육법, 고등교육법 등 3법으로 분리 제정함으로 구축된 체계이다. 이후 평생교육법과 유아교육법이 제정되어 기본적인 교육법 체계가 완성되었다. 본 연구는 1997년 교육법 체계의 개편 이후 현재의 시대적 상황을 반영한 교육법 체계의 새로운 구상을 다루는 것을 목적으로 한 것이다. 교육법 체계가 헌법 개정론이 강하게 제기되고 있는 흐름에 부응하도록 하고, 1997년 개편 당시와 달라진 현 시점에서의 평생학습 강화의 교육 환경을 반영하도록 하기 위한 것이다. 관련 문헌들을 망라하여 연구한 성과를 요약하면, 4차 산업혁명시대를 맞아 헌법을 개정해서 학습권을 명시적으로 보장하자는 것, 국민들의 학습권 보장을 위한 기본법제로 평생교육법에서 평생학습 관련 조문들을 따로 모아 평생학습법으로 신설 제정하거나 교육기본법과 통합하여 “평생학습을 위한 교육기본법”으로 개편하자는 것, 평생교육법에서 특히 사회교육에 관한 조문들은 따로 모아 사회교육법을 분리･제정하자는 것 등이다. 본 연구에서 미처 다루지 못한 연구영역에 대해서는 또 다른 차원의 연구가 이어져야 할 것이다. 본고의 교육법 체계에 관한 연구가 향후 이 주제 하의 또 다른 연구를 위한 기본 발제로서의 역할을 담당할 수 있기를 기대한다.

영문 초록

The current education law system reflects various educational reform legislative measures in accordance with the recommendation of the Presidential Advisory Board on Education Reform on May 31, 1995. The current education law system was completed on Dec 12, 1997 by separating the old education law into three laws: the Basic Act on Education, the Elementary and Secondary Education Act, and the Higher Education Act. The purpose of this study is to address a new conception of the educational law system that reflects the current times since the reform of the educational law system in 1997. The purpose is twofold. The first is to re-examine and reflect what was not reflected in the education law system reform proposal proposed by the Education Reform Committee in 1995. Second, it reflects the educational environment of strengthening lifelong learning at this point, which has changed from the time of the 1997 reorganization. A summary of the achievements studied across the relevant literature is as follows : Revising the Constitution to explicitly guarantee rights to learning in the era of the Fourth Industrial Revolution, establishing a new lifelong learning law by separately collecting lifelong learning-related provisions from the Lifeiong Education Act or reorganizing it into the “Frame Work Act on Education for Lifetime Learning” in conjunction with the Frame Work Act on Education. In the Lifetime Education Act, separating social education laws from the Lifelong Education Law and enacting Social Education Laws. We hope that this research on the educational law system will serve as the foundation for another study under this topic in the future.
