국문 초록

학교현장에서는 아직도 학교폭력으로 인하여 많은 학생들이 고통 받고 있다. 학교폭력의 양상이 다양해지고, 장소도 학교 밖으로 확산되는 등의 진화가 되고 있어 학교폭력이 안전한 학교생활을 지속적으로 위협하고 있다. 이러한 학교폭력문제를 해결하기 위해 소년법의 소년분류심사제도를 착안하여 ‘학생분류심사제도(가칭)’를 제안하였다. 특히, 학교폭력의 문제가 지속적으로 심각해지고 있는 현 상황에서 학교폭력의 해결의 열쇠는 결국 가해학생이 가지고 있는 것이고, 이러한 가해학생의 학교폭력에 대한 가해행위를 막는 것은 가해학생이 왜 학교폭력을 하게 되었는지에 대한 신상관계, 신체적, 심리적, 환경적, 행동적 측면에 대한 정보를 통하여 그 원인과 이유를 밝혀내고, 향후 학교폭력이 발생할 수 있는 원인을 제거함으로써 학교폭력으로부터 안전을 확보할 수 있다고 보았다. 학생분류심사제도는 개인적인 자질에 대한 조사와 진단을 통하여 학생의 학교폭력에 대한 원인을 찾아서 적절한 보호와 조치를 위해 심의위원회에 최적의 정보를 제공하고, 향후 학생의 학교폭력의 가해 발생률을 줄이는데 있어 큰 도움이 될 것이며, 학교폭력이 없는 행복한 학생으로 성장하는데 밑거름이 될 것이다.

영문 초록

In schools, many students are still suffering from school violence. The aspects of school violence are diversifying, and places where it occurs are spreading to areas such as outside the school. School violence continues to threaten safe school life. In order to solve this problem of school violence, this study suggests a ‘student classification review system’ (tentative name) based on the juvenile classification review system of the Juvenile Act. In particular, at a time when the school violence problem continues to deteriorate, the key to solving school violence lies with the perpetrator students. To prevent such bullying behavior, it is important to find out the causes and reasons through information about the personal relationship, physical, psychological, environmental, and behavioral aspects of why the bullying student committed school violence. It is believed that safety from school violence can be secured by removing the causes of future school violence. The student classification review system will provide optimal information to the review committee for appropriate protection and action by finding the causes of student violence through investigation and diagnosis of individual qualities. It will be of great help in reducing the incidence of school violence in the future and will serve as a foundation for helping students to grow happily without school violence.
