교육제도법정주의 측면에서 본 자율형 학교 관련 법제화 논의

국문 초록

본 논문은 교육제도법정주의 측면에서 자율형 학교 관련 법제화에 대해 논의한 글이다. 구체적으로 Ⅱ장에서 관련 법령을 검토하고, 교육제도법정주의와 관련된 쟁점을 논의하였으며, Ⅲ장에서는 미국과 영국의 입법 사례를 검토하였다. 마지막 Ⅳ장은 법제화를 위한 교육의 본질적 가치와 그에 따른 시사점을 논의하였다. 자율형 학교는 획일적 교육을 탈피하여 교육의 다양성･자율성 확보를 목적으로 시행되었으나. 그 과정에서 교육 불평등과 교육의 중립성 훼손 논란을 가져왔다. 여기서 ‘교육의 다양성･자율성’, ‘교육의 중립성’, ‘교육을 통한 사회적 불평등 완화’는 교육의 본질적 가치이자 헌법적 가치에 해당한다. 그러나 우리의 교육 현실에서 상기 가치들은 서로 충돌하는 속성을 보이기도 한다. 교육제도법정주의의 의의는 이러한 교육의 본질적 가치의 조화와 실현을 위해 국민의 대표기관인 국회의 입법절차를 통하여 공론화 과정을 제공하고, 사회적 합의를 도출하는데 있다. 교육적 가치의 조화를 위한 입법 논의가 필요하다.

영문 초록

This article addresses the discussion of the legalization of autonomous schools from the point of view of the codification of an educational system. Specifically, relevant laws and regulations are reviewed and issues related to codification are discussed in Chapter II. Legislative cases in the United States and the United Kingdom are reviewed in Chapter III, and in Chapter IV, the essential value of education for legalization as well as its implications are discussed. Autonomous schools are typically implemented for the purpose of establishing diversity and autonomy in education, specifically by breaking away from uniform education. However, this process can also bring about educational inequality and controversy by undermining neutrality in education. Here, “diversity and autonomy of education,” “neutrality of education,” and “reducing social inequality through education” are essential constitutional values related to education as emphasized by the codification of an educational system. But in our educational reality, the above values also reveal conflicting properties. The significance of the codification of an education system is to facilitate public discussion through the legislative process, for the goal of harmonization and the realization of the essential values of education as well as to determine social consensus.
