외국인 수용자의 시설 내 처우복지 실태 및 개선방안

국문 초록

본 연구의 목적은 최근 증가하고 있는 외국인 수용자들을 대상으로 복지적 측면에서 현 상황을 재고해 보고, 향후 외국인 수용자의 시설 내 처우 방향을 모색해 보고자 함에 있다. 이에 본 연구는 외국인 수용자의 시설 내 처우복지에 관하여 근거가 되는 ‘외국인 수용자 처우 지침’ 법령을 살펴보았고, 현재 천안교도소에서 외국인 수용자에게 실시되고 있는 교정 복지 프로그램을 살펴보았다. 연구 결과, 첫째, 우리나라는 ‘외국인 수용자 처우 지침’을 근거로 외국인 수용자에 대한 처우를 뒷받침하고 있다. 그러나 외국인 수용자의 처우 근거가 되는 법령인 ‘외국인 수용자 처우 지침’이 2002년 제정 이후 개정되지 않고 있으며, 국제규약의 권고를 잘 따르지 못하고 있는 것으로 나타났다. 둘째, 현재 천안교도소에서는 외국인 수용자가 시설 내 생활의 어려움을 해소하고자 다양한 프로그램을 실시하고 있다. 하지만 일부 프로그램이 한국 문화에 초점을 맞춰 일방적으로 진행되고 있으며 수용자가 시설 내 생활함에 있어서 스트레스를 가중시킬 수 있다는 문제가 나타나고 있다. 이에 본 연구는 다음과 같이 개선 방안을 제안하였다. 외국인 수용자 처우 지침의 개선 방안으로는, 첫째, 외국인 수용자에 대한 통역 제공이 필요하다. 둘째, 외국인 수용자의 교육ㆍ교화프로그램, 직업훈련 등의 별도 조 문화가 필요하다. 셋째, 외국인 전담교정부서의 설치 명문화가 필요하다. 이러한 부분이 개선된다면 외국인 수용자 처우에 관한 규정을 세부적으로 명확히 할 수 있으며, 외국인 수용자의 교정 복지도 증진될 것이다. 현재 천안교도소에서 실시되고 있는 프로그램의 개선 방안으로는, 첫째, 외국인 교도소 프로그램 내 민간 협약 활성화가 필요하다. 둘째, 자국 문화 향유 기회의 제공이 필요하다. 외국인 수용자 각각의 특성에 적합한 프로그램을 제공하고 한국 문화에 국한되지 않고 자국 문화와 융합한 프로그램을 제공한다면 외국인 수용자의 처우에 있어서 큰 기여를 할 것이다. 본 연구는 외국인 수용자의 시설 내 처우 법령과 천안교도소 현행 프로그램을 중심으로 정리하여 문제점과 그에 따른 개선방안을 제안하였다. 본 연구의 한계점은 양적 자료가 풍부하지 못해 일반화하기는 어렵다는 것이다. 교도소 내에서 프로그램을 수행하고 있는 외국인 수용자의 불편 사항 등을 청취할 수 있는 기회가 부족했으며, 여러 개선방안에 대한 예산 문제도 논의가 필요할 것이다. 또한, 수용자에 대한 응보적인 입장을 가진 대다수 국민의 여론을 만족시키기 위해서 구체적이고 확실한 방안을 통한 사회적 합의를 얻어야 할 것이다. 하지만 본 연구는 외국인 수용자 처우의 기본이 되는 ’외국인 수용자 처우지침‘이 국제규약의 권고사항을 충족하지 못하고 있어 이를 충족하기 위한 개정이 이루어져야 한다는 것을 시사한다는 점에 의의가 있다.

영문 초록

The purpose of this study is to reconsider the current situation in terms of welfare for the growing number of foreign inmates and seek future treatment in facilities. In addition, we would like to consider legislation that needs to be added or modified in the Foreign Inmate Treatment Guidelines, which serve as the basis for the treatment of foreign inmates, and discuss what effect it will have when applied. According to the research, the welfare of foreign inmates in facilities was divided into the laws that provide the basis for the treatment of foreign inmates in facilities and the current status of programs conducted at Cheon-an Prison. Korea supports the treatment of foreign inmates based on the treatment guidelines of foreign inmates. However, the Guidelines for the Treatment of Foreign inmates, a law that serves as the basis for the treatment of foreign inmates, have not been revised since its enactment in 2002, and have failed to comply with the recommendations of international protocols. As an improvement to this, this study proposes that : First, a separate legislation such as education, educational programs, and vocational training of foreign inmates is needed. Second, it is necessary to establish a correctional office dedicated to foreigners. Detailed clarification of regulations on the treatment of foreign inmates can promote the correctional welfare of inmates and achieve their goals. Currently, Cheon-an Prison is conducting various programs in terms of correctional welfare to solve the difficulties of foreign inmates living in the facility. However, some programs are unilaterally focused on Korean culture, which can add to the stress of inmates lives. As a way to improve this, first, it is necessary to revitalize private agreements in foreign prison programs. Secondly, it is necessary to provide opportunities to enjoy its own culture. Providing programs suitable for each characteristic of foreign inmates and programs that are not limited to Korean culture, it will greatly contribute to the treatment of foreign inmates. This study summarized the treatment of foreign inmates in facilities, focusing on statutes and current programs, and proposed limitations and improvement measures. The limitation of this study is that quantitative limits exist. There was a lack of opportunity to actually listen to complaints from foreign inmates carrying out programs in prisons, and budget issues should also be discussed to achieve the purpose of the study. In order to satisfy the public opinion of the majority who have a punitive stance on inmates, social consensus must be obtained through concrete and confident measures. However, this study is significant in suggesting that The Foreign Prisoner Treatment Guidelines , which underlie the treatment of foreign inmates, do not meet the recommendations of international conventions and must be revised to meet them.
