국문 초록

노인 인구의 증가로 각종 질병, 노화 등으로 거동이 불편한 사람들은 스스로 일상생활을 할 수 없으므로 요양보호사의 돌봄을 받아야 한다. 요양보호사는 일정한 교육을 받고 시험에 합격해야만 요양보호사 자격이 주어진다. 요양보호사는 이렇게 전문성을 갖추고 간병의 질적 서비스를 제공하기 위해 노력하고 있다. 이러한 노력에도 불구하고 요 보호자에 의한 요양보호사에 대한 신체적 폭력, 언어적 폭력, 성범죄 등이 행해지고 있다. 이로 인해 요양보호사는 심한 스트레스에 노출된 채 업무를 하고 있다. 이러한 범죄의 문제점을 지적하고 그 문제에 대한 대응방안을 논의하는 것이 연구의 목적이다. 연구의 방법으로 선행 연구논문이나 연구보고서 등을 바탕으로 요양보호사에 대한 범죄 발생의 실태를 살펴보고 이를 바탕으로 어떤 유형의 범죄가 발생하는지와 그 범죄 발생에 대한 다양한 문제점을 파악하는 것이다. 다음으로 인터넷 자료를 통해 요양보호사에 대한 다양한 범죄 발생 사례 등을 통하여 범죄가 발생할 수밖에 없는 구조적 문제점을 파악하고 그 범죄의 심각성을 논하는 것이다. 연구결과 요양보호사에 대한 요보호자의 범죄는 증거확보의 어려움과 소속기관의 묵인이 맞물려 계속 발생할 수밖에 없는 구조적 한계를 가지고 있다. 따라서 요양보호사가 웨어러블 캠을 이용하여 범죄 장면을 촬영함으로써 증거를 확보할 수 있고 그 증거를 바탕으로 가해자를 처벌할 수 있으므로 범죄예방과 근절을 기대할 수 있다. 웨어러블 캠 시행에 따른 요보호자의 사생활 침해문제, 웨어러블 캠 탈취 및 파손, 예산문제, 고장, 촬영물에 대한 증거능력 인정문제, 법률상 문제 등 다양한 문제점이 나타날 수 있다. 따라서 지방자치단체 한 곳을 정하여 시범운영을 하여야 한다. 그 이유는 운영으로 인한 예상하지 못한 다양한 문제점이 나타날 수 있고 그 문제에 대한 개선과 효과성 검증이 이루어진 상태에서 전국적 확대시행이 되어야 하기 때문이다. 결론적으로 인간의 한계를 극복할 수 있는 첨단과학을 이용한 범죄예방 및 근절은 앞으로 우리가 나아가야 할 방향이다. 2020년 10월 20일 국회의원 정춘숙 의원이 요양보호사에 대한 범죄의 심각성을 인식하고 범죄근절을 관계기관에 요청하고 있다. 하지만 현재까지 그 기관은 뾰족한 대책을 제시하지 못하고 있다. 그 이유는 아마도 요양보호사에 대한 범죄 방지 대책을 수립하기가 쉽지 않기 때문일 것이다. 따라서 본 논문은 관계기관에서 대책을 수립하는데 조금이나마 보탬이 될 수 있도록 한다는 점에서 의미가 있다.

영문 초록

The increase in the elderly population means that people who have difficulty moving due to various diseases and aging cannot live their daily lives on their own, so they should be taken care of by a caregiver. Nursing caregivers are eligible for nursing care only when they receive a certain education and pass the nursing caregiver test. Therefore, caregivers are trying to be professional and provide quality services for care. Despite these efforts, the guardian practices physical violence, verbal violence, and sex crimes against nursing caregivers. As a result, caregivers are working under severe stress. The purpose of the study is to point out the problems of these crimes and discuss how to respond to them. The research method is to identify the actual state of crime against caregivers based on prior research papers or research reports. Based on this, it is to identify what types of crimes occur and various problems about them. The next step is to identify various cases of crimes against caregivers through Internet data. Based on the case, the government identifies structural problems that inevitably lead to crimes and discusses the seriousness of the crime. According to the study, the crime of the caregiver against the caregiver has structural limitations that inevitably occur due to the difficulty of securing evidence and the acquiescence of the affiliated institution. Therefore, it is possible for caregivers to secure evidence by filming crime scenes using wearable cameras and punish perpetrators based on the evidence, so crime prevention and eradication can be expected. Various problems can arise from the implementation of wearable cameras, including privacy violations of key guardians, theft and damage of wearable cameras, budget problems, breakdowns, recognition of evidence ability for photographs, and legal problems. Therefore, one local government shall be determined and operated on a trial basis. This is because various unexpected problems can arise from the operation, and it should be expanded nationwide with improvement and effectiveness verification on the problem. In conclusion, crime prevention and eradication using high-tech science, which can overcome human limitations, is a way forward. On October 20, 2020, lawmaker Chung Chun-sook recognizes the seriousness of the crime against nursing care workers and asks related agencies to eradicate the crime. But so far, the agency has failed to come up with a sharp measure. The reason may be that it is not easy to establish crime prevention measures for caregivers. Therefore, this paper is meaningful in that it allows related agencies to contribute a little to establish countermeasures.
