지방정부의 해양 관련 조례의 유형 분석과 정책적 함의

국문 초록

본 연구에서는 국내 해양 관련 조례의 동향분석을 통해 정책적 함의를 이끌어 내고자 하였다. 특히 해양 관련 상위 법률을 검토하고, 지난 20여 년간 제정·운영되어 온 광역 시·도의 해양 관련 조례 동향을 살펴보고, 유형을 분류하여 이에 근거하여 내용을 분석하였다. 또한 11개 광역 시·도의 해양 관련 조례 현황을 파악하고 그 유형을 분석함으로써 지방정부 차원의 효율적인 해양 관련 체제 구축과 해양자원의 효율적인 활용을 위한 지방정부의 역할 강화방안을 모색하였다. 현행 11개 시·도의 해양 관련 조례 57건을 분석한 결과, 2005년부터 2018년까지 연평균 약 2건에 불과했던 조례 제정 건수가 2019년 19건, 2020년 12건으로 대폭 증가하고 있는 것으로 나타났으며, 해양 관련 법률의 유형과 해양정책영역의 분류를 토대로 「지방자치법」 제9조에 따른 지방자치단체의 사무를 고려하여 크게 해양공간, 해양산업 , 해양환경, 해양문화 등으로 분류한 후, 각 유형별로 조례의 내용을 목적 및 효과, 주요내용, 핵심정의로 나누어 관련 세부내용을 분석하였다. 이러한 분석결과를 토대로 도출한 정책적 함의는 다음과 같다. 첫째, 법령을 근거로 하여 제정된 조례는 법령 상에 규정된 내용을 반복하여 재규정할 필요가 없으므로 지방자치단체의 특성을 반영하여 법령에 없는 내용을 중심으로 조례를 규정하는 것이 바람직하며, 자치조례는 다른 시·도의 조례를 그대로 모방하는 것이 아닌, 해당 지방자치단체의 특성을 최대한 살린 조례가 되도록 하여야 한다. 둘째, 국가 균형적 발전과 지역적 특성에 맞는 해양 관련 정책이 전개되어야 한다. 공공기관 지방이전 및 혁신도시 추진에 따라 해양수산 관련 기관은 대부분 부산권·경남권 중심으로 집중되고 있는 추세이다. 셋째, 해양자원의 가치를 보전하고, 주민의 정주여건 및 생활환경을 개선시켜야 한다. 국가는 우리나라 해양 전체를 고려하여 정책을 수립해야 하지만, 해양자원을 보유하고 있는 지방정부의 경우에는 각 지방정부별로 정책을 유연하게 수립하고 실현할 수 있으므로 향후 자치분권 시대에 부합하는 지방정부의 해양 관련 정책이 발전할 수 있는 가능성을 실현시킬 수 있는 시점이다.

영문 초록

In this study, it was intended to derive policy implications by analyzing trends in domestic maritime-related ordinances. In particular, the maritime-related laws were reviewed, the trends of maritime-related ordinances in metropolitan cities and provinces that have been enacted and operated for the past 20 years, the types were classified and analyzed based on this. In addition, the government sought ways to strengthen the role of local governments for the efficient establishment of marine-related systems at the local government level and the efficient use of marine resources by analyzing the current status of marine-related ordinances in 11 metropolitan cities and provinces. According to the analysis of 55 maritime-related ordinances in 11 cities and provinces, the number of ordinances from 2005 to 2018 has increased significantly from 19 in 2019 to 12 in 2020. The ordinances were classified as urban, construction, economic, environment, education, welfare, autonomy, and administration. The policy implications derived from these analysis results are as follows: First, the government is required to foster related industries and improve infrastructure, especially in marine areas with high potential development value in the future, breaking away from the existing inland balanced development paradigm, including metropolitan cities and provinces. Second, it is necessary to create a marine city that meets the era of internationalization. Third, marine-related policies should be implemented to suit regional characteristics. Following the relocation of public institutions to provincial areas and the promotion of innovative cities, most of the maritime and fisheries-related institutions are concentrated in Busan and South Gyeongsang Province. Fourth, the value of marine resources shall be preserved, and the settlement conditions and living environment of residents shall be improved. The country should establish policies considering the entire Korean ocean, but in the case of local governments with marine resources, each local government can flexibly establish and realize the possibility of developing maritime-related policies in the future.
