국문 초록

9/11 테러 이후 심각한 비대칭적·비전통적 위협에 직면한 미국 부시행정부는 대테러리즘과 반WMD 정책을 기반으로 관련 법령을 제정하고 국가안보기구를 개혁하였다. 2001년 10월 ‘애국법(USA Patriot Act)’을 제정하고 2003년 1월 미국 본토내 테러방지에 역점을 두면서 새로운 비대칭적·비전통적 위협에 대비하기위해 ‘국토안보부(DHS)’를 신설하였다. 또한 CIA와 FBI 등의 대테러리즘 센터를 통합하여 2004년 8월에는 ‘국가대테러리즘센터(NCTC)’가 신설되었다. 아울러 정보공동체의 통합적 운영과 개혁을 위해 2004년 12월 ‘2004년 정보개혁 및 테러리즘 예방 법안(IRTPA)’이 통과되어 미국정보공동체를 지휘·감독하는 ‘국가정보국장(DNI)’ 직위를 신설하였다. 한편 부시행정부 NSC는 국가안보 전략과 관련해 2002년과 2006년 ‘국가안보전략 보고서(NSS)’ 및 대테러리즘 전략과 관련해 2003년과 2006년 ‘대테러리즘 국가전략 보고서(NSCT)’를 발간하고 이를 기반으로 대테러리즘 정책을 추진하고 있다. 미국의 대테러리즘 조직과 정책에 대한 분석에 기초해 도출된 한국의 대테러리즘 조직과 정책에 대한 함의는 다음과 같다. 첫째, 향후 법적 근거를 마련하여 테러 징후·예측정보의 수집과 판단, 정보 분석·전파, 협상, 인질구출, 사후수습 등 임무에 관한 조직과 업무분장을 규정하여 총괄적 대테러리즘 조직 구축과 활동을 강화해야 할 것이다. 둘째, 해외에서 한국 교민, 여행객, 기업 등에 대한 테러 위협에 대비하기 위해 외교통상부 다자외교조약실 산하 ‘안보대테러협력과’의 조직과 기능을 강화해야한다. 셋째, 국방부, 경찰청 및 해양경찰청의 대테러 활동과 관련 법령에 있어 국정원과의 통합된 체계가 필요하다. 넷째, 대테러리즘 전략적 차원에서 한국도 외교적 협상뿐만 아니라 공공외교, 경제 제재 및 유인, 비밀활동, 송환/법집행 협력, 정보제공에 대한 보상, 군사력, 국제협정 등에 대한 다각적 전략을 검토·개발해야 할 것이다. 다섯째, 한국정부도 현재 국정원의 테러정보통합센터의 임무를 확대하여 미국의 NCTC와 유사한 조직을 신설하고 대테러리즘 정보와 작전기획 등을 총괄하는 조직을 신설해야 할 것이다.

영문 초록

In the face of asymmetric threats since 9/11 terror, Bush administration has adopted counterterrorism and anti-WMD policies and sought to establish laws and reform organizations of national security. First, U.S. enacted the USA PATRIOT Act in October 2001 and established Department of Homeland Security which prevent and deter terrorist attacks and protect against and respond to threats and hazards to the nation. Moreover, U.S. established the National Counterterrorism Center in August 2004. In December 2004, Director of National Intelligence was created based on Intelligence Reform and Terrorism Prevention Act of 2004 so as to integrate intelligence matters related to the national security and oversees and directs the implementation of the National Intelligence Program. In addition, the White House NSC has published National Security Strategy of the United States(2002/2006) related to national security strategies and National Strategy for Combating Terrorism(2003/2006) related to counterterrorism strategies. Based on these assessments on U.S. counterterrorism organization and strategy, ROK government has to pursue following policy options. First, legislation of laws of terrorism prevention is urgent to strengthen effective counterterrorism activities and to conduct collection of early warning signal, analysis, dissemination, negotiation, and hostage rescue. Second, since overseas activities of Koreans by companies, travellers, reporters etc. have rapidly expanded, ROK needs to enhance MOFAT’s counterterrorism capabilities and safeguarding Koreans abroad. Third, government should make every effort to integrate Ministry of Defense and Police with NIS in the areas of counterterrorism activities and laws. Fourth, ROK seeks to develop diverse counterterrorism strategies through the direct or indirect use of diplomatic, economic, intelligence, law enforcement and military instruments. Furthermore, ROK has to develop special forces’ capability for counterterrorist operations and take active measures against domestic terrorism. Finally, ROK needs to reorganize Terrorism Information Integration Center in efforts to accomplish and coordinate terrorism intelligence and strategic operational planning in combating terrorism.
