국문 초록

한국, 미국, 호주, 싱가포르 등의 국가들은 저작권법에 기술적 보호조치를 보호하는 규정을 마련하였다. 그런데 디지털화된 저작물을 이용하는 환경에서 기술적 보호조치가 저작권 보호를 위해 필수적임에도, 이용자가 저작물에 접근하는 것을 기술적 보호조치에 의해 원천적으로 봉쇄하는 것은 이용자의 저작물의 공정한 이용에 상당한 제약을 가하게 된다. 이러한 문제를 완화하기 위해 각국은 일정한 사유에 따라 특정한 저작물에 적용된 기술적 보호조치를 무력화하는 행위를 허용하는 규정들을 위 규정과 함께 마련하였다. 제104조의2 제1항 각호는 접근통제 기술적 보호조치의 무력화 금지의 예외를 규정하고, 동항 제8호는 “기술적 보호조치의 무력화 금지에 의하여 특정 종류의 저작물등을 정당하게 이용하는 것이 불합리하게 영향을 받거나 받을 가능성이 있다고 인정되어 대통령령으로 정하는 절차에 따라 문화체육관광부장관이 정하여 고시하는 경우. 이 경우 그 예외의 효력은 3년으로 한다.”고 규정하여 문화체육관광부장관이 고시를 통해 추가적인 예외를 시행할 수 있도록 했다. 이에 따라 문화체육관광부는 2012년 1월 31일에 첫 번째, 2015년 1월 31일에 두 번째 및 2018년 1월 31일에 세 번째 고시를 마련하여 시행하였고, 2021년 1월 31일에 네 번째 『기술적 보호조치의 무력화 금지에 대한 예외』를 고시하였다. 이 논문은 미국, 호주 및 싱가포르의 예외 설정의 현황에 관하여 살펴보고, 2021년 1월 31일에 고시된 기술적 보호조치의 무력화 금지에 대한 예외의 배경과 내용에 대해 검토하였다.

영문 초록

Countries such as Korea, the United States, Australia, and Singapore have established regulations in copyright law to protect technical protection measures. However, although technical protection measures are essential for copyright protection in an environment where digitized works are used, fundamentally blocking users’ access to works by technical protection measures imposes considerable restrictions on the fair use of works by users. In order to alleviate this problem, countries have come up with regulations that allow the act of circumventing the technical protection measures applied to certain works for specific reasons in the above regulations. Each subparagraph of Article 104-2 (1) stipulates the exception of the prohibition of circumventing access control technical protective measures, and subparagraph 8 of the same paragraph states, “Cases determined and publicly notified by the Minister of Culture, Sports and Tourism according to the procedures prescribed by Presidential Decree as it is deemed that the legitimate use of works, etc. of specific types is unreasonably affected or likely to be affected by the prohibition of circumventing technological protection measures. In such cases, the effect of such exception shall be valid for three years.” Accordingly, the Ministry of Culture, Sports and Tourism prepared and implemented the first notice on January 31, 2012, the second notice on January 31, 2015, and the third notice on January 31, 2018. And on January 31, 2021, the fourth notice of the Exception to the Prohibition of Circumventing Technical Protection Measures was announced. Accordingly, this paper examines the status of exceptions in the United States, Australia and Singapore, and explaines and reviewes the background and contents of the Exception to the Prohibition of Circumventing Technical Protection Measures announced on January 31, 2021.
